Government Affairs Updates
CBIA Housing Killer and Creators List 
The California Building Industry Association has released their much-anticipated Housing Killer and Creator list. The list details several legislative proposals by the California Legislature that will either hurt or create housing. This year’s list touches on legislation related to high risk fire zones, labor related liabilities, density bonus and impact fees. 
Laguna Hills Mall Redevelopment – Call to Action 
Calling all Members! On Tuesday, April 27, 2021, the City of Laguna Hills will vote whether to approve the Village at Laguna Hills project and it is extremely important that your voice is heard! Please join us and provide your comments to the City Council. The team will work with you to make this as easy as possible and can provide talking points if you need them. They will even feed you before the meeting! Speaking at a city council meeting in support of the Building Industry will make you eligible for the BIAOC Government Affairs Award and Civic Advocacy League.

San Clemente Inclusionary Zoning Decrease 
The City of San Clemente has updated their Inclusionary Zoning (IZ) policy. Over the course of the last year, the City has held multiple study sessions with the Planning Commission and City Council to look at their current policy and if it needs updating. The BIA, along with many other business groups, continually spoke against any increases to the policy, and advocated for continuity and streamlining. Staff ultimately moved forward with a proposal that would increase the IZ in-lieu fee by 369-433%. The BIA, along with our coalition partners, adamantly opposed this increase, asking for the policy to be reduced or to remain the same. After a lengthy council debate, the City voted 3-2 to keep the fee as is and to reduce the onsite requirement from 4% to 2%. Should you have any questions, please contact Steve LaMotte at SLaMotte@biaoc.com
La Habra City Council Approves Inclusionary Zoning Policy 
As reported prior, the City of La Habra pushed forward an inclusionary zoning (IZ) policy last year. Due to coalition engagement, the council voted unanimously to postpone the discussion. However, the policy returned to council this month and was approved with a 3-2 vote. Mayor Espinoza, Mayor Pro Tem Medrano and Councilmember Simonian cited the Regional Housing Needs Assessment (RHNA) as one of the reasons for approving this policy, even with staff and the BIA, reminding them that IZ has nothing to do with cities meeting RHNA requirements. Further, the proposed in-lieu fee language was vague and unclear and could have amounted to an astronomical fee on new housing. Thankfully, the council added a much lower $6.50/sq. ft in-lieu fee before approving the policy. For more information, please contact Steve LaMotte at SLaMotte@biaoc.com or check out the Voice of OC article here.
Lawsuit may be game changer in battle against cities hostile to new housing
Check out the Opinion Editorial by Steve LaMotte and Adam Wood on the recent denial of the Rancho La Habra project and the subsequent lawsuit against the City of La Habra. 
BIAOC Supports Senate Bill 719
The BIAOC submitted a support letter on Senate Bill 719 this month. SB 719 by Senator Min (Costa Mesa) codifies a flexible and reasonable aggregate affordable housing mandate for Tustin Legacy (former MCAS Tustin) and provides flexibility under the revised Surplus Land Act, given the unique circumstances of redeveloping a former military base by the City of Tustin. In a nut shell, a recent revision to the surplus land act unintentionally captured larger base reuse projects such as the Tustin Legacy. Should the base remain as surplus land, the years of redevelopment planning as well as the agreement between the city and the federal government could be stifled by endless bureaucracy. The Bill was passed out of its first committee on April 8th and looks to be headed to the committee on appropriations. Click here to stay up to date.
