This week, Carrier Law attorney, Bill Bereza, received notice that the Court of Appeals ruled in his favor.

Here's a few details about the case:

The clients are going through Medicaid for the husband, who is living in a nursing home. We were able to get the husband on Medicaid, and the clients were able to preserve their savings. We also want to preserve 100% of his pension for her benefit. This requires a court order.

The judge refused to approve our clients’ agreement. We said that the judge has to accept the clients’ wishes since they are both competent and it was agreed to by them both, so it must be enforced like any contract. So, we appealed the judge’s decision to the Court of Appeals which agrees with us.

A couple is allowed to agree to any property transfer in a separate maintenance agreement, and a Circuit Court judge doesn’t have the right to change that.
