Worker Safety and Underground Utility Bill Signed Into Law


This Wednesday, Governor Walz signed AGC-led worker safety and underground utility damage prevention legislation into law.

 

The language was included in the transportation policy bill, which received broad bipartisan support and unanimous support in the Senate (97-30 vote in the House and 67-0 in the Senate). In the era of divisive politics, it’s important to highlight this area of agreement for our bill and many other policy issues. We urged the legislature to act this session and are thrilled it has crossed the finish line.

 

“At its core, this legislation is about safety,” said Laura Ziegler, Director of Highway/Heavy and Government Affairs for AGC of Minnesota. “State statute in 2024 is based on outdated technology and processes for marking and mapping underground infrastructure. There haven’t been significant updates in almost 40 years. This often leaves contractors and project owners in the dark. While our contractor members are the ones directly digging into the ground, this legislation impacts every Minnesotan.”

 

House author Representative Larry Kraft led negotiations throughout session. “Digging in the wrong place can result in impacts ranging from a nuisance, to shutting down a facility or street, to putting lives at risk,” said Kraft. “In 2026, there’s a huge amount of broadband investment coming to Minnesota as part of federal programs. We want to address these necessary statute updates now to prepare. Can you imagine being an excavator and hitting something you didn’t know was there – which could be really dangerous – and then having to dig again the next day?”

The updates to Chapter 216D improve the quality of mapped underground utilities by leveraging technology that didn’t exist when the statutes were written. Geospatial location of newly installed underground lines would be required beginning in 2026 to accurately document a line’s vertical and horizontal placement.

 

Kraft and Senate author John Hoffman also emphasized enhancing information sharing amongst all parties involved in a construction project. Those changes include updated timelines for completing utility locates and implementing statewide tracking of unintentional hits and the accuracy of utility marks.

 

“It’s clear why this bill has support from both sides of the aisle: because it allows our project managers, contractors, property owners and public utilities to better communicate and collaborate in support of greater safety for our entire state,” said Hoffman. “We are on the precipice of significant investment in the infrastructure that will propel Minnesota forward. This bill will help us do that work safely.”

The Final Countdown


Lawmakers will be at the Capitol through the weekend to finish negotiations and pass remaining priority bills before the midnight deadline on Sunday. There are 20 or so outstanding bills on various issues from labor to energy to public safety yet to be approved. Floor debates have been long this week and what will be accomplished in the next 48 hours remains to be seen. 


As of this afternoon, an agreement had not been reached on a capital investment bill, referred to as a bonding bill. Negotiations on the overall bill have come in at $890M on the low end and $930M on the high end. Other issues that are brought into negotiations as part of a broader leadership agreement, including minimum pay for ride sharing services, continue to hold up final agreement on a bonding bill.

Welcome, Stacy!


AGC of Minnesota is excited to announce the addition of Stacy Arnold CSP, AC as the Director of Safety and the CHASE (Construction Health and Safety Excellence) Partnership ProgramStacy brings over 20 years of construction design, project management, and safety leadership to the AGC team. We are thrilled to have Stacy join AGC. Her extensive technical background in Safety Management and her understanding of field leadership are fundamental to the growth of the CHASE partnership and represent just a portion of what Stacy will bring to the membership. 


Stacy has a strong understanding of contractor safety needs, having previously served as Director of Safety for AGC member RJM Construction, where she educated, mentored, and championed best-in-class safety for the entire organization.   


Stacy holds degrees in Construction Management from MN State University Moorehead and Architectural Construction Technology from St. Cloud Technical College. She also holds certificates from AIC as a Certified Associate Constructor and maintains the credential of Certified Safety Professional (CSP).

LABOR NEWS

Cement Masons North Dakota Labor Update


AGC wrapped up most of its negotiations this year, with Cement Masons building for NW MN and ND being ratified by members last weekend. The union members rejected the Highway Heavy ND settlement. If you are signatory to the HH ND agreement and have not spoken with Mike, be sure to email him as soon as possible to receive updates and help guide negotiations at this critical impasse. 


Interim Agreement

If you have received an interim agreement from the union, AGC recommends to not sign this interim agreement. We are negotiating a clearer interim agreement that preserves the status quo. (If you have given AGC bargaining authority, then you are protected.)  Again, email Mike if you have any questions.

LEGAL NEWS

AGC Partners with MAPA before Minnesota Supreme Court


AGC joined with Minnesota Asphalt Pavement Association to jointly petition the Minnesota Supreme Court to reverse a Court of Appeals decision that harms contractors. 


In this case, a highway contractor won a MnDOT bid for roadwork but its haul routes were rejected because, per the jury, MnDOT wanted to accommodate a county official’s concerns about the impact on the road and difficulty working with MnDOT. Changing the haul routes increased the cost of the project about 20% and MnDOT denied a change order. The contractor sued and won in trial court, but the Court of Appeals reversed on a specious legal argument which, if stands, threatens to broaden and undermine the bidding process—essentially giving owners or developers, including MnDOT, huge discretion to change the scope of work or risks without compensating the contractor.


AGC and MAPA are represented by a team of volunteer construction and appellate AGC-partner lawyers from the Bassford Remele law firm, led by Kyle Willems. Thank you, Bassford team, for helping to defend the construction industry on this potentially huge issue.
