New DoD Pilot Program Could Boost Opportunities for Employee-Owned Businesses

The Proposed Rule, if adopted, would implement Congressional directives from the FY22 and FY24 National Defense Authorization Acts. In particular, the Proposed Rule would amend the Defense Acquisition Regulation Supplement (“DFARS”) to allow contracting officers to award one sole-source, follow-on contract for the continued development, production, or provision of products or services that are the same or substantially similar to those procured under previous contracts awarded by or for DoD to a “qualified business.” A “qualified business” is defined as an S-corporation for which 100 percent of the outstanding stock is held through an ESOP.

Defense Federal Acquisition Regulation Supplement: Restriction on Certain Metal Products (DFARS Case 2021-D015)

DoD is issuing a final rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to implement a section of the National Defense Authorization Act of Fiscal Year 2021 that provides restrictions on the acquisition of certain covered materials from The Democratic People's Republic of North Korea, The People's Republic of China, The Russian Federation, and The Islamic Republic of Iran. Effective May 30, 2024.

The Navy wants to crowdsource innovation

CTO urges the Navy Department to hold more “structured challenges” to spur breakthroughs. A May 25 memo from acting Chief Technical Officer Justin Fanelli directs the Department of the Navy to “adopt more broadly” the use of contests “to solve specific problems or explore innovative solutions.”  Additional comments from Defense One and link to memo at

Eliminating Self-Certification for Service-Disabled Veteran-Owned Small Businesses 

This direct final rule contains amendments to the regulations governing the U.S. Small Business Administration's (SBA) Veteran Small Business Certification (VetCert) Program. The SBA is revising its regulations to implement a provision in the National Defense Authorization Act for Fiscal Year 2024 (NDAA 2024), which eliminates self-certification for service-disabled veteran-owned small businesses that are awarded Federal Government contracts or subcontracts that count towards agency or subcontracting goals This direct final rule amends SBA's regulations to carry out the changes made by NDAA 2024. This rule is effective August 5, 2024 without further action, unless adverse comment is received no later than July 8, 2024. If significant adverse comment is received, SBA will publish a timely withdrawal of the rule in the Federal Register.
