This session will present issues of interest to real estate attorneys, title insurance agents and title examiners. The main topic addressed will be the nature of the real property interest of the railroad company in the area within its right-of-way: That is, is the interest that of a fee ownership or an easement only? Also presented will be sub-topics on the acquisition of railroads of rights-of-way by condemnation and the effect of abandonment of the right-of-way. The session will focus on Virginia law, but an extended study of the United States Supreme Court case, Brandt Revocable Trust v. United States, will be included as it may be seen as holding that a railroad right-of-way is an easement only, at least on lands formerly owned by the United States.

This course is approved for 1-hour of CE, CLE and CCE (VCTE & VCTSA) credits. If you received credit for the live version of this course, you cannot receive credit for the online version even though the course numbers differ.
