DISAPPOINTMENT #1

      About a year ago, President Trump issued an order to halt the issuance of immigrant visas to beneficiaries of approved petitions by family relatives and by sponsoring employers, from all countries.
 
           It was expected that President Biden would cancel this order and would resume visa issuance to such approved beneficiaries who have been waiting for consular interviews and immigrant visas for many months. It was expected that this might happen on Tuesday, February 2, 2021.
 
           To our great disappointment, it did not happen. The ban on legal immigration from all countries is still in place. To our astonishment, we were not given an explanation why and for how long this ban will continue.
NEW SECRETARY OF
HOMELAND SECURITY
 
           On Tuesday, February 2, 2021, the U.S. Senate finally approved the appointment of Mr. Alejandro Mayorkas to the position of Secretary of Homeland Security. This makes him the new “boss” of what used to be the “Immigration Service”, and now is divided into three (3) organs: U.S. Citizenship & Immigration Service (USCIS), U.S. Immigration & Customs Enforcement (USICE) and U.S. Customs & Border Protection (USCBP). Actually, the Department of Homeland Security (DHS) is a huge department with responsibility for many different functions, in addition to immigration.
 
           It is noted that Mr. Alejandro Mayorkas is the first Latino and the first Refugee to serve in this position. He was brought by his parents from Cuba to the U.S. when he was five (5) years old.
 
           Congratulations and Good Luck to Mr. Mayorkas.
 
REVIEW OF ALL IMMIGRATION POLICIES
 
           On Tuesday, February 2, 2021, President Biden issued an Executive Order requiring the Secretaries of Homeland Security, the Department of State and the Attorney General to conduct a review of all immigration policies and submit to recommendations for changes within 180 days (six months). Also, a faster review of the Trump Regulations in the area of Public Charge.
 
           As usual – wait and see.
           SAFETY IN VACCINATIONS
 
           On Monday, February 1, 2021, DHS announced that USICE and USCBP will not conduct enforcement operations at or near vaccine distribution sites or clinics.
        
   If you are an undocumented alien, do not hesitate to go to any mass vaccination sites. You may meet a nurse with a needle, but not an ICE officer with handcuffs.
 
NEW IMMIGRATION LAW
 
           Not yet.
 
           The White House, or the Congress, has not published as yet the actual text of the new Immigration Law that President Biden wishes to enact.
 
           Therefore, we still do not know what could be the requirements for the new legalization, or Amnesty Program. The only advice we can provide is: keep your employment records and copies of your Income Tax Returns (in chronological order), keep your old passports (with which you entered the U.S.) with your visas and Forms I-94 (if you had visas and I-94s), prepare your and your family’s personal documents, such as birth certificates, marriage and divorce certificates, school records of yourself and your children, any medical or financial records, and anything else that proves when you came to the U.S. and how long you have been in the U.S.
 
           You will certainly need all such documents.
