The Ontario Supreme Court Ruling On The Pro Hamas U of T Encampment Legitimized Hamas Calls For Intifada And Destroying Israel

The Hon. Judge Markus Koehnen appears to disregard serious allegations of antisemitism made by the Jewish community. In his ruling, Judge Koehnen stated:

"For purposes of this motion, I do not have to determine how these phrases and symbols are being used. I review this history and analysis merely to point out that the automatic conclusion that those phrases are antisemitic is not justified; especially not on an interlocutory injunction”.

The judge appeared to dismiss key antisemitic indicators, including a photograph depicting the "blood libel," the "inverted triangle" associated with Hamas, the phrases "Intifada" and "Free Palestine by any means necessary," and the globally recognized slogan "from the river to the sea," often used by pro-Palestinian activists (which has been condemned globally as a call for genocide of the Jewish people).

By challenging the widely accepted definition of antisemitism as established by the International Holocaust Remembrance Alliance (IHRA), Judge Koehnen's decision appears to introduce uncertainty. He asserts that "part of the controversy arises out of the absence of an agreed definition of antisemitism" and notes discord within Jewish communities over the IHRA definition. In fact, the dissenting opinions are by a radical anti-Zionist fringe not associated with the established Jewish community consensus.
