Ninth Circuit Court

of Appeals, Federal Bar, State Bar Hosting CLE

The U.S. Court of Appeals for the Ninth Circuit, the Nevada Chapter of the Federal Bar Association, and the State Bar of Nevada are sponsoring a free CLE titled “The Art of Appellate Advocacy: A View from the Ninth Circuit Bench,” from 2-4 p.m. on Tuesday, October 8, in the jury assembly room at the Lloyd D. George U.S. Courthouse in Las Vegas. There will also be a Zoom option.


Ninth Circuit judges (who will be sitting in October), and Susan V. Gelmis, chief deputy clerk for operations, will present on effective brief writing and oral argument, give an insider’s guide to Ninth Circuit Practice, and update attendees on recent policy changes.

 

A reception will immediately follow the program.

This Week at the State Bar

The Eighth Judicial District Court Business Court Bench-Bar meeting will be held from noon until 1 p.m. on Thursday, August 22, at the Regional Justice Center in Courtroom 16A. There will also be a Zoom option. The meeting ID is 819 5989 8821, and the passcode is 881405.

The Nevada Supreme Court has issued an order inviting public comments in Administrative Order ADKT 0594 regarding the administration of the Nevada Bar Exam. The deadline to file comments is 5 p.m. August 16, 2024. Comments may be submitted to the court in hard-copy format or electronically to nvscclerk@nvcourts.nv.gov.

Applications Available for Vacancy in First Judicial District

Governor Joe Lombardo announced the retirement of the Honorable James T. Russell from the First Judicial District Court of Nevada, Department 1. Russell will retire at the end of October 2024.


The Commission on Judicial Selection will convene to fill the forthcoming vacancy left by Russell’s retirement. The application period opens Monday, August 12, and submissions are due by noon on Thursday, September 19.


Applicants interested in applying must contact Margarita Bautista at mbautista@nvcourts.nv.gov to receive the required application materials. Materials will not be released prior to August 12.

Couvillier’s Investiture Ceremony Set for September 26

U.S. District Court Magistrate Judge Maximiliano D. Couvillier III will be ceremonially sworn in at an investiture at 5 p.m. on Thursday, September 26, in the jury assembly room at the Lloyd D. George Federal Courthouse in Las Vegas.

 

Couvillier is a founding partner of Kennedy & Couvillier, PLLC. Prior to establishing that firm, he was a partner at Lionel Sawyer & Collins and managing partner at Black & LoBello. Couvillier served as the general counsel for the Legal Aid Center of Southern Nevada (2011-13) and then as president of its Board of Directors (2014-23). He also served as president of the Nevada Latino Bar Association and chair of the State Bar of Nevada’s Litigation Section.

 

Couvillier received his law degree from California Western School of Law, graduating cum laude, and his Bachelor of Arts in political science from the University of California at San Diego (Thurgood Marshall College).

 

Couvillier assumed the position of U.S. Magistrate Judge on January 8. The term of the appointment is eight years.

State Bar Hiring Outreach and Programs Specialist

The State Bar of Nevada is accepting applications for an outreach and programs specialist. This is a full-time, exempt position within the bar’s Administration department.

 

The position strategizes for and implements diversity, equity, and inclusion projects/initiatives. The position works alongside various groups and state bar licensees engaged in promoting participation by minorities in state bar programs and activities through existing program management and implementation of new programs and services. This position will support state bar section leaders and provide support for the Nevada Bar Foundation, the state bar’s 501(c)(3) charitable organization.

 

Education and experience required include a bachelor’s degree and at least five years prior related work experience, or equivalent combination of education and experience.

Applicants Sought for Standing Committee on Judicial Ethics

The Standing Committee on Judicial Ethics seeks to fill two vacancies. The state bar’s Board of Governors shall appoint an attorney member to fill each vacancy. 

 

The Standing Committee on Judicial Ethics provides judges and aspirants to judicial office advisory opinions regarding ethical matters that may arise in the ordinary course of judicial service, or in the elective or appointment process. 

 

Interested applicants should complete an online application form.

Standing Commission on Judicial Discipline has Opening

The Commission on Judicial Discipline seeks to fill a vacancy for an alternate commissioner. The applicant must be from any county other than Clark County. 

 

The commission investigates allegations of judicial misconduct in office, violations of the Revised Nevada Code of Judicial Conduct, or disability of judges.

 

Interested applicants should complete an online application form. 


All applications must be received no later than noon on Thursday, August 15.

Legal Aid Center Hosting CLEs in August

The Legal Aid Center of Southern Nevada (LASCN) is hosting two CLEs in August.

 

Nevada Supreme Court Justice Patricia Lee, Judge Deborah Westbrook of the Nevada Court of Appeals, and Judge Nadia Krall of the Eighth Judicial District Court will share the top 10 things they want all attorneys to know when it comes to court orders during a CLE titled “Top 10 Things to Know About Court Orders” from 4-6 p.m. on Tuesday, August 13, in the Engelstad Family Classroom.

 

LACSN is also hosting Intro to Representing Children in Abuse & Neglect Cases,” from 10 a.m. until noon on Friday, August 23; and from 1-3 p.m. on Thursday, October 10, in the Engelstad Family Classroom and via Google Meet.


In this course, attorneys will learn how to effectively represent children in foster care. In Nevada, children are parties to an abuse/neglect case brought by a child welfare agency. Under Nevada law, those children have a right to be represented by an attorney. Attorneys from the Children’s Attorneys Project (CAP) will teach attendees how to establish an attorney/client relationship with clients of all ages. The class will provide an overview of the child welfare system and the life of an abuse/neglect case. The class will also touch upon common issues, including sibling connections, mental health, and delayed permanency.

Featured CLE: Trial Academy

The trial academy is a four-day immersive experience that builds trial skills in a simulated environment. Attendance is limited to 24. The schedule consists of: 

 

  • September 6: Classroom sessions will establish a baseline of how-to best practices and what to do during trial, including theme and theory, opening statements and closing arguments, direct and cross examinations, and evidence fundamentals. 
  • September 13: The second session will include additional classroom sessions and practical application of the concepts learned over the first two days. 
  • September 20: During the third session, the 24 students will be divided into six teams of four students. Teams will work closely with instructor coaches and complete a dry run of the mock trial that they will participate in on day four. 
  • September 27: During the final day, students will gather in teams of four at the Eighth Judicial District Courthouse. The teams will participate in a mock trial in front of sitting district court judges. The judge will be joined by two to three jurors, and all will be scoring the competition. The individual advocate with the highest score will be awarded the Best Advocate award for the academy.

 

This is a live event only. The first three days will take place at the State Bar of Nevada offices in Las Vegas, while the final day will take place in courtrooms.
