Indefinite Detention at Guantánamo: How the National Defense Authorization Act Results in Indefinite Detention in Violation of Authorization Act Results in Indefinite Detention in Violation of International Human Rights

Many of the remaining detainees at Guantanamo Bay Detention Center have been cleared for transfer but are being detained indefinitely. This indefinite detention violates international human rights and costs the US government millions of dollars annually. In order for the US to comply with its obligations under international human rights law, Congress must create a private right of action under international human rights treaties, the Supreme Court must declare that active hostilities ended with the war in Afghanistan, and the Biden administration must create an executive office dedicated to transferring the approved detainees.

Supreme Court Ethics Regulation: Amending the Ethics in Government Act of 1978 to Address Justices’ Unethical Behavior

The United States Supreme Court is tasked with resolving difficult questions of law and its legitimacy lies with its ability to be perceived as a fair and impartial body. However, the Court’s ability to remain independent has recently been questioned and the Justices’ decisions are increasingly viewed as polarized along ideological lines. She argues the Ethics in Government Act of 1978 serves as precedent for congressional intervention with judicial transparency and suggests amendments Congress can enact to strengthen the Court’s legitimacy.

“There is No Perfect Solution Here”: An Analysis of Sibling Placement Decisions in the California Dependency System

Many children who experience abuse or neglect get pulled into the dependency system and face yet another form of potential trauma – separation from their siblings. Placement decisions for sibling groups are often made based on a judge’s subjective opinion or the limitations of potential placements. By prioritizing a child’s wishes and the child’s own agency, outcomes for sibling groups in the dependency system could be drastically improved.

Papers may be on any topic either directly discussing an aspect of the Rule of Law, demonstrating how the Rule of Law affected the topic, defining the Rule of Law, criticizing the Rule of Law, or demonstrating the economic social or political effects of the Rule of Law.
