Before she could react, a car had run the light and T-boned the driver side of CR's car, causing it to spin around. One minute before the crash, CR, a former deputy sheriff, was a very active citizen in good physical and mental health. Years prior, CR had undergone shoulder surgery. Yet, she had healed well and was "living her best life." She was independent and vibrant, enjoying traveling, volunteering, working as a private caretaker and tutor to two middle school-aged children, and spending time with family. The at-fault party's insurance company argued, as always, that the crash did not cause CR's shoulder condition because of the previous surgery. The fact that CR had a pre-existing injury to her shoulder, which had well-healed and returned to normal use, was a far cry from her torn rotator cuff. It is never fun to get served lawsuit papers. When sued in a personal injury case, most often you have insurance. The insurance company has likely failed to fairly and timely pay the injury claim leaving you in a real jam that takes your time and jeopardizes your personal assets. The other possibility is that the at-fault party is intentionally under-insured, and is attempting to protect a wealth of assets. The insurance company has a duty to investigate and timely pay claims fairly. Insurance companies notoriously delay and deny in effect harming both the injured and the at-fault insured. The insured has the right to have private counsel to ensure that the insurance company and its lawyer representing you are properly fulfilling their duties. When they do not, the suit will likely go forth.

TERMINOLOGY: "Causation"

Causation, in legal terms, refers to the relationship of cause and effect between one event or action and the result. It is the act or process that produces an effect. In a personal injury case, one must establish causation—meaning that it’s not enough to show that the defendant was negligent. The negligence must be what caused the complainant’s injuries.
