PT Compact Commission Adopts Changes to Rules, Bylaws, and Policies & Procedures

 

The Physical Therapy Compact Commission (PTCC) held a special meeting on June 17, 2024, to adopt amendments to the Commission's Rules, Bylaws, and Policies & Procedures.


The Commission amended rules 1.1, 2.3, and 3.5 to clarify the expiration date of the home state license and the compact privilege. Rule 3.1 was also amended to change the timeframe of how long a compact privilege holder must report a change in home state. The amendment changed the timeframe from 30 days to 60 days.


The PTCC Bylaws were amended to establish a process for a member state to identify a contingent Delegate who will represent the jurisdiction in the event the originally selected Delegate is unable to fulfill the duties of the Delegate.


Finally, the Policies & Procedures were updated to address the process of reviewing any newly enacted legislation that varies from the model statutory language.

PT Compact Executive Board Reviews FL & MN Legislation

 

At its meeting on May 5, the PT Compact Executive Board reviewed Florida's SB 7016 and Minnesota's HF 5247.


Upon review of the legislation, it was determined that both bills contained material deviations from the model compact statute. As a result, both Florida and Minnesota were deemed ineligible for membership in the Physical Therapy Compact and physical therapists and physical therapist assistants licensed in Florida and Minnesota are ineligible to obtain compact privileges in other compact states.

 

If either jurisdiction enacts subsequent legislation that remediates the material deviation, the Executive Board will review the updated legislation to determine if the jurisdiction would be eligible for compact membership.

Recent Legislative Updates

 

Late in the legislative season, there is progress being made on enacting the compact legislation in some states.


On June 25, Governor Dan McKee signed SB 2876 into law, making Rhode Island the 38th member of the PT Compact. In May, the Alaska legislature passed SB 74. The bill is now waiting for Governor Mike Dunleavy to sign the legislation. Once that occurs, Alaska will become the 39th compact state. We expect the bill to be signed later this month.


In addition to Alaska and Rhode Island, there is a possibility that the legislation in Massachusetts and Michigan will be passed before the end of 2024.


Legislation to fix the criminal background check issue was enacted in Kansas. This bill goes into effect on July 1. We are hopeful that this will allow Kansas to become an active jurisdiction by the end of 2024. A criminal background check fix bill is also making its way through the legislative process in Pennsylvania. SB 1165 has passed out of the Senate and is awaiting a vote by the full House of Representatives.
