Summary: Health Care Facilities

A bill to amend the South Carolina Code of Laws by adding Section 44-7-267 so as to prohibit the use of contractual agreements by health care facilities to limit a physician's ability to practice after termination of the contractual relationship, with exceptions. Click here for bill updates.

The Notice of Final Regulation (NFR) for Regulation 61-64, X-Rays (Title B), went into effect May 26, 2023. You can view a copy of the NFR on page 206 of the State Register. Practices should be sure their imaging teams are aware of the updates.

DEA News
New DEA Education Requirement effective June 27, 2023
The new education requirement for all DEA-registered practitioners to complete 8 hours of training on “the treatment and management of patients with opioid or other substance use disorders” is effective June 27, 2023. DEA Extends Telehealth Flexibilities
The following is a message from the American Medical Association (AMA):
The ability to prescribe controlled substances based on telehealth patient visits was set to expire when the COVID-19 Public Health Emergency ended on Thursday, May 11th. The U.S. Drug Enforcement Administration (DEA) initially issued two proposed rules establishing new policies for controlled substance prescriptions based on telehealth visits, one for buprenorphine and one for other controlled substances. The AMA weighed in on the policy with multiple arms of the Biden administration, including the DEA as well as Rahul Gupta, MD, the Director of the White House Office of National Drug Control Policy. After receiving more than 38,000 comment letters, however, the DEA has decided to extend the same policies that have been in place during COVID for an additional 6 months, until November 11, 2023. The AMA has issued a statement welcoming this extension.

Cigna Delaying Implementation of the Modifier 25 Policy
Message from the American Medical Association (AMA):
We wanted to alert you that Cigna has updated its modifier 25 policy to announce a delay in implementing the required submission of documentation to support the use of modifier 25 when billed with E/M CPT codes 99212 – 99215 and a minor procedure. 
 
Although the AMA has not yet received a formal response to the sign-on letter sent in April to Cigna about the policy, we have received the following details regarding its announced delay:
  • Cigna is delaying the implementation of the modifier 25 policy.
  • Cigna is currently reevaluating this reimbursement policy update, which will delay implementation.
  • Cigna will look to implement this policy later, when it can optimize the provider experience and perform additional provider education in partnership with key national medical associations.
  • Cigna will communicate a new implementation date and additional details later.
  • Cigna appreciates your partnership and patience and look forward to working more collaboratively with provider partners, medical associations, and their membership to ensure that modifier 25 is used appropriately and in alignment with national guidelines and industry standards.
Congress Extends Deadline for #FixPriorAuth Dear Colleague Letter!
The below message is from the American Medical Association (AMA):
Recently we alerted you that the #FixPriorAuth champions in the House and Senate had introduced "Dear Colleague" letters urging the Centers for Medicare & Medicaid Services (CMS) to strengthen and finalize proposed rules to improve the prior authorization process for physicians and patients.
Due to overwhelming action from advocates like you, the House and Senate sponsors were inundated with colleagues who wanted to sign-on - in fact, the response has been so great that the sponsors have extended the sign-on deadline to June 9!
 
Commercial Payers Delay Paying Out Claims to Providers

Hospitals and health systems were optimistic about their financial performance to start the year, figuring that revenue and profit margins would rebound after a tough few years. But their financial performance has continued to struggle. A new Crowe analysis places much of the responsibility at the feet of commercial payers, finding frequent initial claims denials and other impediments to payments to hospitals.
