CON Action Alert
CON Repeal is NOT a done deal! 
S. 290 State Health Facility Licensure Act repealing Certificate of Need for all facilities and services except nursing homes passed the Senate on January 25. The CON Repeal Bill must still pass the House before it can be forwarded to the Governor and enacted. We expect opponents of repeal to seek reform instead.
 
The House Ways & Means Committee created a special Ad Hoc Committee chaired by Gary Simrill (Rock Hill) to study S. 290/CON and take testimony.
We originally expected this committee to meet this week, but we’ve been told to expect the first meeting during the week of April 18, 2022.

Orthopaedic Surgeon Charged with Healthcare Fraud by DOJ for Upcoding E/M Visits
An orthopaedic surgeon in MA was arrested for health care fraud on March 22. The Department of Justice alleges that he billed higher E/M visits than he could have possibly performed based on his daily appointment schedules reflecting between 60-90 patients per day. Auditors compared the schedule volume, which indicated each appointment could have only lasted 5 minutes, to the E/M codes billed for those visits, which indicated visits lasting 15-45 minutes. Bill to Promote Physician Mental Health Signed into Law
Content via the American Medical Association (AMA):
The Dr. Lorna Breen Health Care Provider Protection Act has been signed into law by President Joe Biden. The bill is designed to bolster the mental health infrastructure supporting physicians and other health professionals by establishing:

  • Grants for health professionals to help create evidence-based strategies to reduce burnout and the associated secondary mental health conditions related to job stress.
  • A national campaign to encourage health professionals to prioritize their mental health and to use available mental and behavioral health services.
  • Grants for employee education and peer-support programming.

The legislation also funds a comprehensive study on the mental health and burnout of doctors and other health professionals. To continue reading, click here.
HHS Secretary Expresses Interest in Medicare Fee Schedule Reform

HHS Secretary Xavier Becerra said recently that he is "definitely interested" in looking at reforming the Medicare Physician Fee Schedule.

"I'm definitely interested, because I remember those 'cliffs' when I was in Congress," Becerra said in a briefing with a small group of health reporters. Click here to continue reading.
AMA & Others Study Burnout and Satisfaction
Changes in Burnout and Satisfaction With Work-Life Integration in Physicians and the General US Working Population Between 2011 and 2020
A new study conducted by the American Medical Association, Stanford University, and the Mayo Clinic evaluated the prevalence of burnout and satisfaction with work-life integration among physicians and U.S. workers in 2020 relative to 2011, 2014, and 2017.

The study, which was published in the Mayo Clinic Proceedings, shows that burnout and satisfaction with work-life integration among U.S. physicians improved between 2017 and 2020. Physicians in specialties most impacted by COVID-19 experienced no significant changes in burnout. Additionally, physicians remain at increased risk for burnout relative to workers in other fields. The AMA, Stanford, and Mayo are currently conducting a follow-up national survey to evaluate changes in burnout and professional satisfaction an additional year into the pandemic. Click here to learn more.
