What Charter School Leaders Now Need To Know About Union Organizing
Atlantic Legal Foundation (ALF) Advisory Council Member Thomas V. Walsh has extensive experience advising employers, including leaders of public charter schools, confronted with union organizing drives and related proceedings before the National Labor Relations Board (NLRB).

As Tom explains in a recent update, ALF long has supported school choice and the charter school movement in particular. For example, some years ago ALF published a series of books discussing labor relations in charter schools. Titled Leveling the Playing Field, each book focused on certain states’ specific labor laws applicable to charters and their effect on sound teacher labor relations.

Due to a sea change in the laws, ALF had planned to update these publications, starting with New York. Revision, however, is proving to be difficult. Although state law has yielded to federal law as controlling labor relations affecting charter schools, application and interpretation of federal law is undergoing wholesale change by NLRB. As a result, it is presently impracticable to provide clear labor relations information to charter school leaders.
