2016 Nova Law Review Symposium
Regulating Innovation in Healthcare: Protecting the Public or Stifling Progress?

NSU Shepard Broad College of Law and the Nova Law Review will address the opportunity, legality, advisability, and effects of the regulation of healthcare. 2016 marks the 50th anniversary of the publication of Dr. Henry K. Beecher's 1966 article, "Ethics in clinical research" in The New England Journal of Medicine, one of the major scholarly developments giving rise to the current regulation of human subjects research in the United States. While the symposium is intended to discuss far more than regulation of human subjects research, the article provides a useful jumping-off point for exploring the regulation of innovation throughout the healthcare system.
There will be more than a dozen speakers, including:

October 13-15, 2016
NITA's "learning by doing" program enables you to explore and master best practices in both taking and defending depositions. Practice and perfect your skills and learn to handle ethical issues that arise during depositions and while preparing witnesses. NSU Law Professors Michael Flynn, Kate Webber, and Jayme Cassidy will be hosting the program along with experienced NITA professors.

Mentoring Program 2016
Next Networking Breakfast:
Friday, November 4, 2016, 7:15 - 9:00 a.m.
Shepard Broad College of Law
Join NSU Law for its second annual Mentoring Program taking place throughout the 2016-2017 academic year. Unlike the traditional 1:1 mentoring models often used, the NSU Law Mentoring
Program uses a group mentoring model organized by practice area. Mentees (2L and above) can meet Mentors who practice in an area of the law that interests them. Networking breakfasts and interactive learning presentations for Mentors and Mentees are held every two months during the fall and winter semesters.
A special program for 1Ls to introduce them to the program for the following academic year will be held February 24, 2017.

Sophie Sparrow Presents at NSU Law Faculty Workshop
Sophie Sparrow, professor at University of New Hampshire School of Law, visited NSU Law on September 16th to present at a faculty workshop. Her presentation, "Teaching Professional Competencies and Characteristics Necessary for the Whole Lawyer," focused on ways that law faculty can help develop attentive, respectable, and trust-worthy future attorneys. Sparrow is recognized as one of the Top 25 influential leaders in legal education and served as a visiting professor at Harvard Law School in Spring 2016.

NSU Law Holds Bar Induction Ceremony for New Lawyers
Participating members of the Class of 2016 who passed the July Florida Bar Exam were sworn in to practice at the Bar Induction Ceremony held on September 20th. NSU Law Dean Jon Garon welcomed the group, congratulating the new lawyers and their families for their hard work and support, often after making many sacrifices to get to this day.

May (JD 1981) of the 4th District Court of Appeal, The Honorable James Martz (JD 1995) of the 15th Judicial Circuit of Florida, and judges from the 17th Judicial Circuit in Broward County, Florida administered the oath: The Honorable Robert F. Staff Attorney Jayme Cassidy was featured on NITA's blog, The Legal Advocate, for being selected as a
Next Generation Faculty (NGF) member, Class of 2016.
Professor Jane Cross presented on a transactional law panel at the 2016 SALT Teaching Conference on October 1, 2016 at John Marshall Law School in Chicago. Her panel was entitled "Stranger Things? Teaching Social Justice in the Transactional Curriculum." The title of her talk was "Teaching Social Justice in Commercial Law: The Unbanked and Underbanked Population."
Professor Debra Moss Curtis accepted an offer of publication for her latest article,
No Shots, No School, No Kidding: The Legal Profession Needs a Vaccine to Prevent Unprofessionalism, to be published in 28 U. Fla. J.L. & Pub. Pol'y ____ (2017).

Professor Olympia Duhart hosted a roundtable discussion at Elon University School of Law Sept. 6 as part of the
Women in the Law podcast series to launch this fall. This podcast mini-series will advance the conversation on the many challenges, both professional and personal, that women continue to face as members of the legal profession. Duhart is producer for an episode on Women Lawyers in the Media. Professor Duhart presented at the 2016 SALT Teaching Conference Sept. 30 at The John Marshall Law School in Chicago. Her talk was entitled "Important and Different Ways to Promote Diversity in the Law School Classroom," which offered concrete examples of how to integrate diversity initiatives in the law school classroom and community. Professor Duhart also presented a second panel the SALT Conference, "Social Justice Begins at Home: The Pursuit of Full Citizenship for All Members of the Legal Academy." This panel presented the findings of the LWI Professional Status Committee and made a case for extending protections to members of the legal writing community.
Professor Joel Mintz
accepted an invitation to be a featured speaker at a U.S. Department of Justice conference on "The Future of Environmental Law" in early November, in Washington, D.C. His presentation will focus on "The Future of Environmental Civil Enforcement;" Mintz was quoted directly and repeatedly cited in a 26-page minority report that presented the dissenting views of the Democratic members of the U.S. House Judiciary Committee regarding the proposed "Stop Settlement Slush Funds Act of 2016." Last spring, he had submitted written testimony to the Committee pointing out a number of flaws in this bill. If passed and signed by the president, it will establish sweeping changes in the civil enforcement practices of most federal agencies and departments. Mintz submitted a 50-page annual update to his treatise, State and Local Government Environmental Liability (Thomson/West Publishing. 1994). (Publication is expected in October.). Mintz attended the annual SEALS Conference on Amelia Island, where he made a presentation on "How to Prepare to Teach a New Course" in a panel session for "newer law teachers;" and represented NSU Law at the SEALS Steering Committee luncheon meeting. He shared a number of practical problems, drafted and submitted by practicing environmental lawyers from around the United States, that were based on their first hand experiences as practitioners. He is in the process of sorting through, selecting, and editing these problems for inclusion in our forthcoming casebook, A Practical Introduction to Environmental Law. Mintz had a conversation with a reporter for U.S. News and World Report regarding the impact of lawsuits challenging EPA regulations (including recent climate change-related regulations) on the workloads of EPA and Justice Department attorneys and spoke at length with a staff attorney with Public Integrity, a Washington, D.C.-based NGO, on how best to assess how effectively individual state environmental protection agencies are performing their enforcement responsibilities.

Successful Weekend for NSU Law Student Competition Teams
During the final days of September, NSU Law student teams were busy representing NSU Law at competitions across the country.
NSU Trial Association (NTA) was invited to the
Inaguarul Mockingbird Challenge at Faulkner Law School in Montgomery, AL on Sept. 28 - Oct. 2. The team consisted of Nefertari Bennett, Wes Byrum, Natalie Lopez, and Sergio Lozano.
The
E. Earle Zehmer Mock Trial Competition Team traveled to Orlando, FL on Sept. 29 - Oct 1, 2016. Their team included Paul Kowalek, Jamie Nakoa, Francesca Olivier, Yale Sanford, Krystena Geer, Andres Kroboth, Nicholas Palomino, and Roger Powell. The team was able to compete a total of four times and earned three
Best Advocate in a Rounds Awards!
Finally, the
Thomas Tang National Moot Court Team competed on September 30th at the Southern Regional Thomas Tang National Moot Court Competition in Atlanta, GA. The team consisted of Bethany Pandher and Richard Rafuls, who won
Best Brief and
Runner Up! They will represent NSU Law at the National Competition in San Diego, CA on Nov. 3-5, 2016. Congratulations to all of our students for their incredible hard work!

Summer Robertson Hackley (JD 2000), managing partner at Hackley & Robertson, PA, has been awarded the 2016 Distinguished Alumni Award for Shepard Broad College of Law.
