Dear Conservatives,
I am writing this email in response to an email forwarded to voters by JD Zumwalt and written by his girlfriend Maureen Krueger. Krueger chose not to run for District Attorney. She is free to endorse any person she chooses. However, she does not have the right to “hand-pick” her successor. The choice for District Attorney is the decision of the voters. I am disappointed at the extent Krueger is using her position as the current Moore County District Attorney, along with her boyfriend, JD Zumwalt and his use of the radio station WEEB, to influence this election. Reckless disregard of the truth is the definition of an abuse of power.

Because of the continued release of misinformation by District Attorney Kruger, I believe it is necessary to respond to her email.

For example, below, Krueger states that I moved to Moore County in 2019. This is not true. A simple review of the online tax records would show that I moved to Moore County in 2018. Another example, Krueger said that I became a Republican in 2016. A review of the voter registration records, available to the public through the Cumberland County Board of Elections, clearly shows that I registered as a Republican in 2015 and that I left the democratic party in 2012.

It is disheartening the amount of lies and falsehoods some people will sink to in their desperation to win.    I agree that the lies and falsehoods used by Maureen Krueger and JD Zumwalt to benefit Arthur Donadio is a desperate effort to win the election for District Attorney.
 
So many lies - Arthur's been called a Democrat, a Communist, a George Soros Plant, Homosexual, Atheist, an Arsonist, Lazy and now his health is being called into question. It is like the bigger the lie, the more they are pushing it.  
I have never used derogatory terms to describe Arthur Donadio. I have relied upon facts, supported by official records, to provide information to voters to demonstrate that Donadio is not the best choice for District attorney.

FALSE. The chart provided by Maureen Krueger is not an actual “voter history” record from the North Carolina State Board of Elections. This is a chart created by JD Zumwalt and/or Maureen Krueger. Factual information has been omitted from this chart.

Arthur registered as Republican in Moore County in 1997 PARTIAL TRUTH. Arthur Donadio LEFT the Republican party on March 1, 2016 (Donadio’s March 2016 Voter Registration is below). The NC primary was held on March 15, 2016. Arthur Donadio did not vote for President Trump nor any other Republican in the 2016 primary election, because he did not vote in the 2016 primary at all. I voted for President Trump in both the primary and the general election. The information provided by the voter history from the NC State Board of Elections is easily misunderstood. The information sets out what type of primary ballot is requested by the voter. It does not show who the person voted for in the primary or in the general election. It only shows whether the person voted. Donadio has not voted in a primary election since 2014.

Arthur is a professional with experience on both sides of the courtroom, and experience running a prosecutor's office. He is a professional. He is not a politician. 
PARTIAL TRUTH. Donadio has limited prosecutorial experience. Donadio has spent the majority of his career (19+ years) defending criminals. Records from the Administrative Office of the Courts are public information and available upon request.

In Krueger’s endorsement letter, she has alleged that “ Donadio was promoted to the Senior District Attorney position in Montgomery County. Not only did Donadio run the office, he personally tried all of the jury trials, including serious felonies such as murder ”. Krueger goes on to say, “ He has taken to verdict - not just plea bargained - numerous murder cases ”. Krueger also states in her endorsement that “ Donadio has prosecuted and defended the worst of the worst of all killers ”.

Upon review of the official records from the Administrative Office of the Courts, the records show that Donadio has only tried before a jury, four (4) felony cases as a prosecutor. None of these cases are murders or rapes.

Donadio tried (before a jury) as a prosecutor the following felonies:
October 1999 – Charge: Felony Assault with a Deadly Weapon on a Government Officer.
Donadio did not receive a guilty verdict for the felony charge. The defendant was convicted of a misdemeanor by the jury.

March 2000 – Charges: 2 Counts of Felony Common Law Robbery. Result: Guilty Verdict by Jury.

July 2000 – Charge: Felony Assault with a Deadly Weapon with Intent to Kill Inflicting Serious Injury. Result: Verdict of Guilty by Jury.

October 2000 – Charges: 2 Counts of Felony Indecent Liberties with a Child (Child Sexual Abuse). Result: Verdict of Not Guilty

The records demonstrate that Donadio did not try before a jury, as a prosecutor, the “worst of the worst killers”. He has only defended them.

Both Maureen Krueger and Arthur Donadio have indicated that they were first employed in the Moore County District Attorney’s office in 1996. According to the Administrative Office of the Courts records, Donadio was employed in the District Attorney’s Office beginning January 4, 1997. According to his supervisors (not Maureen Krueger), Donadio was assigned to District Court until October 1999 when he was transferred to Montgomery County as the sole assistant district attorney in that office. Donadio did not supervise other attorneys and had no title of “Senior Assistant District Attorney”. Donadio left the District Attorney’s office on October 31, 2000. 
Hardin is a self- admitted lifelong Democrat.  He only registered Republican in Fayetteville in 2016 to run for Judge.   FALSE. I am a lifelong conservative. I have never denied that I was once registered as a democrat. President Reagan and President Trump were also once registered democrats, as was Vice President Pence.

I left the democratic party in 2012. I have never given money to nor voted for a national democratic candidate. I have never voted for nor given money to Obama or Schiff.

Over the last decade, my wife and I have contributed over $21,000 to Republican candidates and causes. We have knocked on doors and worked at polling sites to help get Republicans elected. I ran as a Republican in a democratic district and lost to a democrat. The fact that I failed in this attempt, further supports that I am a conservative Republican. There is no shame in running for office and not “winning”.
                                                                                                
I registered as a Republican in 2015 and have continued to be a Republican. We as Republicans have encouraged conservative democrats to join the Republican party and fight for conservative values. We must embrace conservatives who join the Republican party and be vigilant against those who join the Republican party to obtain a position of power.

FALSE: Mike and Victoria Hardin moved to Moore County in 2018.
and shortly thereafter re-organized his failed political campaign to run here - for an undesignated office    January 2019 – Campaign Finance Law requires that the Treasurer file a report for accounts that are still open. The “Friends of Hardin for Judge” account was still open and had $4,634.58 (CASH) in the account. Campaign Finance Law requires that reports be maintained for all open accounts.

( If you notice, his large campaign signs still have a gavel form the "I" and he put a label over "for Judge" to make it "for District Attorney" ).   TRUE: I have been frugal with the campaign budget. I did re-use large signs to avoid unnecessary costs. 

His campaign is still headquartered in Fayetteville. (documentation also attached).   FALSE. Hardin for District Attorney does not have a formal office and is based out of the Hardin’s home in Southern Pines (Pinehurst mailing address). I did not want to use our home address for the campaign. So instead, I used the address for the campaign’s accountant/Treasurer. The accountant, Florence Black and Associates, is located at 1314 Raeford Rd, STE “A”, Fayetteville, North Carolina.
By contrast to Arthur, Hardin is a slick, professional politician. 
I am a career prosecutor not a politician. I should not be criticized for running a professional campaign. 
Arthur never contributed to Obama or Schiff.  Those contributions were made by his then estranged/separated wife. She has signed an affidavit. A copy of it is attached.  Yet, Hardin pursues this line of misinformation.    FALSE. Donating in the name of another person is a Federal crime. Donadio has been separated from his wife since at least 2014. As of the present time, Donadio is still married and lives with his girlfriend. Donadio has admitted to others that he donated to Obama, explaining that he was in favor of “universal healthcare” because of his concern for a pre-existing health condition. Donadio has provided different explanations for the donations to Obama and Schiff on Facebook. In his October 2019 Facebook post, titled “A message from the candidate”, Donadio states, “In 2012 my then-wife and I were concerned about a health condition and were interested in supporting the candidate who was not campaigning on eliminating coverage for pre-existing conditions ” (Obama).  On March 29, 2019, Donadio contributed to Schiff the day after President called for Schiff's resignation.

Hardin admits that he supported Democrat candidates and voted for them. PARTIALLY TRUE. In Cumberland County, local candidates were either “conservative democrats” or “liberal democrats”. If you wanted to vote for local candidates (such as District Attorney, District Court Judges, etc.), you had to vote in the democratic primary. For quite some time, there were no Republican candidates in the Cumberland County local elections. I have NEVER voted for nor contributed to a national democratic candidate such as Obama.

He claims that the only choice in Fayetteville was between conservative democrats and liberal democrats. Not true. Here are just some of the Republicans that Hardin passed over to vote for Democrats: Pat McCrory, Dan Forest, Elizabeth Dole, Richard Burr and George Little. (These files are too big to attach but you can verify them on the Cumberland County Board of Elections website)  FALSE. Pat McCrory, Dan Forest, Elizabeth Dole, Richard Burr and George Little were not local candidates. I voted for Republican candidates in the general election. Further, my wife and I have contributed to Pat McCrory, Dan Forest, and Richard Burr, as well as other Republican candidates/causes over the last decade totaling $21,061.57. George Little presently serves on my campaign committee.

It's a low blow to call out someone on their health, but since the lies are out there, let's just compare... Arthur is a guy who played high school and collegiate sports... he works out almost daily, and his hobby is medieval fighting complete with  chain mail, metal armor, swords and jousting .  Does this sound like a sickly weakling to you?  FALSE. I have not “called out” Donadio on his health. Donadio told me, and others, that he closed his law office and took the position in the DA’s office to have a “less stressful” job and for insurance benefits.

Mike, on the other hand, announced at a recent forum that he needed to stretch because sitting made his back hurt.    TRUE. In July 2018, I was in a horrific car crash, while driving to work. I am lucky to be alive! I broke my back and sternum. I wore a back brace for nearly six months. I still experience discomfort at times. I agree that it is a low blow to call someone out on their health. My back injury has never prevented me from doing my job. In fact, in August 2018, I tried before a jury, a double capital murder case, while in a back brace. The trial lasted three months and I obtained guilty verdicts for 2 counts of First Degree Murder.

I see Arthur's work ethic in play on a daily basis - and have seen it for almost 25 years. He is tireless.  He does his work, and willingly takes on work for others. He is a masterful trial attorney, and a great colleague. He still works "in the field" with officers - even going out to late night traffic checkpoints and crime scenes.   I have always had a good relationship with law enforcement. The officers know that they can call me at any time, day or night. I am often called out to the scene of serious felonies and homicides. I am endorsed by both the Hoke County Sheriff (Democrat) and the Scotland County Sheriff (Republican). I am endorsed by the Fraternal Order of Police. I am supported by local law enforcement.

Here are just three facts they don't want you to know: 
1) Not one but two of Hardin's supporters are disbarred attorneys (Southerland and Blalock) who lost their law licenses for embezzling - Hardin's office gave them both a pass ...no charges were filed!  Blalock is openly campaigning and fundraising in Moore County for Hardin.    PARTIALLY TRUE: I presently have over 128 donors to my campaign for District Attorney. https://www.ncsbe.gov/Campaign-Finance
Harry Southerland attended a public event in Hoke County. I did not solicit funds from Harry Southerland. However, I received a $100 contribution from him. Southerland was disbarred in 2013.
I have never received funds from Lisa Blalock. Lisa Blalock surrendered her law license on January 24, 2020.
The NC State Bar notifies the District Attorney’s office if there is suspected criminal activity. The NC State Bar has not notified the District Attorney’s office of any criminal activity involving Lisa Blalock. Trust Account violations by attorneys do not always rise to the level of criminal conduct. I have not been provided with any information from the NC State Bar concerning Ms. Blalock, other than what is contained in the Order of Disbarment.

2) Hardin's failed judicial campaign owes his wife $40,000.00. They carried over this debt to the DA campaign and can use this campaign to pay off that debt.   FALSE. Victoria and I contributed $40,000 (CASH) of our own money for my Judicial campaign in 2016. This loan was in addition to us contributing thousands of dollars to the judicial campaign through both cash and additional in-kind contributions, totaling approximately $23,408.03. The accountant recorded the $40,000.00 as a loan to the campaign since it was a cash contribution from us. At the conclusion of the 2016 election, $4,634.58 (CASH) remained in the account. In 2019, the account was re-named “Hardin for District Attorney”. The $4,634.58 (CASH) remained in the account for over 3 years. If we intended on repaying the $40,000 loan to ourselves, we could have removed the $4,634.58 (CASH) at any time.

My wife and I have already spent over $40,000 of our own personal funds on the current campaign for District Attorney. My wife and I have saved and planned for this campaign. My wife has her own law firm and earns a good income.

3) Hardin touts himself as an successful prosecutor of sex cases, yet his District (Hoke and Scotland) have a shameful track record.  
Scotland County has a ZERO percent conviction rate according to report. published last year (Moore County was ranked above average with a 42% conviction rate)   FALSE. In March 2019, the Carolina Public Press, a media group, analyzed limited North Carolina statewide court data on sexual assaults. In conducting this analysis, the Carolina Public Press only analyzed certain categories of data, under very specific parameters. The statistics were flawed and it was called to the attention of Carolina Public Press. Had the cases been properly analyzed, Hoke County’s conviction rate would have been accurately reported as 87.50%. Members of Carolina Public Press graciously discussed these cases and the statistics with me. Carolina Public Press acknowledged errors in data received from the Administrative Office of the Courts and information that may have been inaccurately reported to calculate the statistical rate of conviction for Hoke County. The Hoke County District Attorney’s Office requested that Carolina Public Press issue a retraction or clarification. However, since no direct media articles cited statistics for Hoke County, they declined to issue a retraction or clarification. 
 
You are free to share any of this information if you want.  It is all verifiable. It is sad that this desperate Fayetteville politico has to resort to a whispery smear campaign instead of relying on facts. 

In conclusion, the continued misinformation being distributed to members of the Moore County Republican party in an effort to influence this election should be closely scrutinized.
