What's the Difference Between Withdrawn and Cancelled?


The Withdrawn status is used when the marketing of a listing has been temporarily suspended and no showings are allowed, yet the listing agreement between the seller and the broker remains in effect. 

 

The Cancelled status is used when the listing agreement between the seller and the broker has been terminated prior to the Expiration Date. 

 

When reporting the correct listing status to the MLS, please be sure you are choosing the correct option on the Listing Agreement Termination/Withdrawal form found in zipForms. For the Withdrawn status please be sure to select Section I - WITHDRAWAL FROM MARKET. For the Cancelled status please be sure to select Section II – TERMINATION OF LISTING AGREEMENT. 

 

When editing a listing’s status, if you do not see the option to Cancel the listing, you will need to speak with your office to have the status changed for you. 

Can I Use My Nickname in the MLS?



Licenses are issued in the licensee’s legal name and that is the name that is required by the Maine Real Estate Commission to be used in advertising. A nickname can be added to the legal name in the MLS as long as it is differentiated in some way. For example: Susan {Sue} Smith. A nickname cannot replace a legal name in the MLS. The reasoning for the use of the legal name is for transparency to the consumer. A consumer needs to understand who they are dealing with and can obtain information if necessary.

 

It has been made clear that Maine Listings users must do business as they are licensed by the Commission and over the next several weeks, staff will be working to update the Maine Listings membership database to display legal names in the MLS. If you already have a nickname on file – there is no action required on your part. If you wish to add a nickname to your MLS user profile, please email processing@mainelistings.com and be sure to include your 6-digit user ID and preferred nickname.  

Annual Renewal of End User License Agreement (EULA)


Maine Listings strives to utilize best practices within the real estate industry and part of that duty is to make sure we have the proper protection in place to safeguard your data. That's why it's important to make sure all users read and understand the terms and conditions of the End User License Agreement (EULA). Renewal of the EULA is done annually.


On Tuesday, January 10, 2023, a new EULA will be added to the login of Flexmls and all users will be asked to review and accept the terms of the EULA by clicking the "I Agree" button.

Statistics Reports!


We’re excited to announce staff has been busy at work re-designing the Maine Listings Statistics program to not only calculate co-list and co-sell market share but also improve the performance in the amount of time it takes to generate a report.


On Wednesday, January 11, 2023, the member only side of MaineListings.com will be taken offline from 7:00 a.m. to 10:00 a.m. as we conduct planned maintenance and roll out the new and improved statistics reports currently found on the private side of MaineListings.com. We hope you’ll take the time to check out the updated statistics reports and let us know what you think!

How's the Market?

You're probably asked on a regular basis, "How's the market?" At Maine Listings, we're all about data and we want to provide you with talking points when someone askes you about the market.


Trend reports are a great way to analyze past and current market behavior. This kind of analysis relies on examining statistical data and recorded market behavior over a defined period of time and Maine Listings has been tracking trends for a number of years. This chart compares the statuses of Active, Active Under Contract, and Pending in the Single Family property type as of the first day of every month since October 1, 2019. As you can see the activity for the past three month has trended downwards, indicating the market is changing.

Compliance Corner ... Get to Know the Rules



Each week, we'll cover a different section of the Maine Listings Rules and Regulations as a quick refresher. This week, we are going to cover Section 11.1 Ownership.

 

In summary, Section 11.1 of the Maine Listings Rules and Regulations states: 


  • All right, title, and interest of MLS compilation created and copyrighted by Maine Listings, shall at all times remain vested in the Maine Real Estate Information System, Inc. 


Don't forget ... there was a policy change to Section 2.6 Reporting Sales Activity to the MLS on January 1, 2023. The number of days to report the status changes will be reduced from five (5) business days to three (3) business days. This does NOT change Section 1 which covers the number of business days to submit a new listing to the MLS.
