A recorded memorandum of lis pendens serves the valuable purpose of notifying potential buyers of pending litigation. Yet, an improperly recorded lis pendens can create mischief on an anticipated real estate and provide unwarranted litigation leverage, hence the creation of the special motion to dismiss procedure.
