BBB direct selling council refers Wayal Health to FTC for alleged unsubstantiated health claims

EDITOR'S NOTE

A compliance inquiry by the Direct Selling Self-Regulatory Council (DSSRC) of the Better Business Bureau identified alleged unsubstantiated health claims in social media posts by Wayal Health Sciences USA, Inc. Alleged claims by the company regarding dietary supplement and topical products included statements such as “helps fight cancer, depression, and attention-deficit hyperactivity disorder” and “Prevent memory decline and reduce the risk of Alzheimer's, cancer and other diseases”.

DSSRC sought contact with Wayal Health to express concern that these are health-related claims requiring substantiation in the form of competent and reliable scientific evidence and seeking participation in the DSSRC self-regulatory forum process. When contacted, Wayal did not provide a substantive response, and the statements in question were not removed. DSSRC has stated that the matter was referred to the FTC for review and possible further action.

Wayal Health Sciences USA, Inc., (“Wayal Health” or the “Company”) is a multi-level direct selling company founded in 2016. The Company is headquartered in Salt Lake City, Utah and markets health and wellness nutritional supplements.

Basis of Inquiry

The Direct Selling Self-Regulatory Council (“DSSRC”) is a national advertising self-regulation program administered by BBB National Programs.

This inquiry was commenced by DSSRC pursuant to its ongoing independent monitoring of advertising in the direct selling marketplace and concerns product performance claims disseminated by the Company and its salesforce members.

The representative claims that formed the basis of this inquiry are set forth below:
