KCL Partner Robert Finkel recently represented ScrubaDub Auto Wash Centers in connection with their purchase and financing of a new facility in Chelsea, Massachusetts. ScrubaDub now operates 18 locations across Massachusetts, New Hampshire, Maine and Rhode Island.

We also congratulate ScrubaDub on their recent spotlight in the Boston Business Journal's Entrepreneur section. Brother Bob and Danny Paisner are the second generation to lead the business started by their parents in 1966. Through their customer-focused orientation and innovative use of technology and reinvestment in their sites, ScrubaDub is expanding and growing.

Court Dismisses Contractor's Claim Against Property Owner

In a recent Massachusetts Superior Court ruling on a motion for summary judgment in Cumberland Farms, Inc. ("CFI") v. Tenacity Construction, Inc. ("Tenacity") , Suffolk Superior Court, No. 15-1589-BLS2, 11/30/16, the Court dismissed the contractor, Tenacity's, claim against the property owner, CFI, for lost productivity due to winter conditions based on a comprehensive no damages for delay clause ("NDDC").

Piercing the Corporate Veil: Court Grants KCL's Client a Real Estate Attachment in a Breach of Contract Claim

The Massachusetts Superior Court for Norfolk County recently granted KCL's client a real estate attachment as prejudgment security in a pending breach of contract law suit. KCL litigation attorney Jeremy Y. Weltman was able to pierce the corporate veil of the limited liability corporation (LLC) to expose the personal assets of one its individual shareholders.
