President's Comments

Dear Members,


I hope this newsletter finds you all in good health and high spirits. As we wrap up the second quarter of the year, I wanted to provide you with an update on our recent legislative efforts concerning Senate Bill 1052.


As you all know, our bill did not progress as we had hoped in the Idaho House of Representatives. Despite the overwhelming support we garnered, our bill was unexpectedly tabled indefinitely by the Speaker of the House, Representative Moyle. This turn of events was both unexpected and somewhat unprecedented.


I want to express my heartfelt gratitude to everyone who dedicated their time, energy, and passion to this legislative endeavor. Our legislative committee, led by Dr. Lauren Huber, worked tirelessly to champion the cause of optometric physicians in Idaho. Your dedication and commitment to advancing our profession are truly commendable. I also want to thank Lisa White, our Executive Director, for her unwavering efforts throughout this process. Her leadership and organizational skills were instrumental in our grassroots campaign. Additionally, I would like to express our sincere appreciation to our esteemed ophthalmology colleagues who stood with us and wrote letters of support. Your solidarity strengthens our professional community and fosters collaboration.


Although our bill did not progress this time, rest assured that this issue is far from resolved. We understand the importance of our goals and will continue to monitor the political climate over the next year or two. We remain committed to bringing this bill forward again when the timing is right.  


As we continue our journey, we will keep you informed of any developments or changes in our legislative efforts. Our dedication to enhancing the optometric profession in Idaho remains unwavering, and we will persevere until we achieve our objectives. Winston Churchill once said, “Success is not final, failure is not fatal: It is the courage to continue that counts." In the meantime, I encourage each of you to stay engaged and connected with the IOP community. Attend our events and continue to advocate for our profession. Your active involvement is crucial as we move forward.


Lastly, I am delighted to extend an invitation to all of our members to join us at our annual congress in Boise this fall. It will be a fantastic opportunity to come together, share knowledge, and strengthen our professional network. We look forward to welcoming each one of you and experiencing the power of our collective passion for optometric excellence.

LEGISLATIVE UPDATES

2023 Legislative Update 

Sine Die Report


On April 06, 2023, the Idaho Legislature completed its business and went Sine Die, which means “without a day” in Latin. The 2023 Legislative Session began slowly due to the many new legislators that were elected last year but it quickly picked up steam during the mid-point of the Session. As expected, a number of big picture issues dealing with education, property taxes, judges, Medicaid, and some culture war issues (abortion, public libraries, transgender rights, etc.) dominated the 2023 Legislative Session.


2023 has been extremely busy on the optometry front, particularly with Senate Bill 1052, which would have allowed optometrists to perform three in-office laser procedures – Laser Capsulotomy, Peripheral Iridotomy, and Laser Trabeculoplasty. To help with this effort, IOP hired two additional lobbying firms to combat the Idaho Society of Ophthalmology, hiring three lobbying firms and one media firm to help kill the bill. 


Senator Scott Grow (R-Eagle), our bill’s sponsor, was very engaged in helping to get the bill through the Senate Health and Welfare Committee on a 6-1 vote and through the Idaho Senate on a veto-proof majority on a vote of 23-11. IOP Members were also critical in reaching out to their Senators and urging them to vote for the bill.


As we headed to the Idaho House of Representatives, we were cautiously optimistic because we had passed a similar laser bill in 2020, and we were confident that we had the majority of the votes in the House Health and Welfare Committee and on the House Floor.  


Unfortunately, we ran into a major roadblock when the bill arrived in the Idaho House of Representatives. The Speaker of the House, Mike Moyle (R-Star) decided unilaterally to kill the bill by sending it to the House Ways and Means Committee, where it died without a hearing. Speaker Moyle raised a number of concerns with the bill and shared his experience with an eye injury, where his vision was saved by an Ophthalmologist who just happened to be the President of the Idaho Society of Ophthalmology.


IOP pushed back hard with e-mails and phone calls asking Republican House Members to urge the Speaker to let the bill be heard and by getting 21 members of the Republican House Caucus, including eight committee chairs, to Co-Sponsor the bill. While we didn’t get the Speaker to reverse his position on S. 1052, he did agree to meet with IOP and ultimately committed to IOP leadership that there will be a laser bill next session. While we don’t know what that bill looks like at this time, we will be negotiating a bill during Summer and Fall of 2023. We will keep you apprised during the negotiating process. It probably goes without saying, but I want to say that we would never have reached this path forward without your timely e-mails and calls to your legislators.


Finally, the Administrative Rules for the profession of optometry that included the various changes that were a direct result of the Zero-Based-Regulation (ZBR) were approved by the 2023 Idaho Legislature and are in full effect.

As you've read in the President's Comments and the Sine Dine report, SB1052 came to an unfortunate and frustrating end. This was due to factors that were completely independent of the bill itself and had virtually nothing to do with the legislation. I know this is politics, but I find it to be an abhorrent example of what can happen in the political system when personal circumstances outweigh what is right and what the majority of the legislative body has shown they want. 


I was so impressed with all our optometrists' hard work during this legislative session. Our 6-1 yes vote count in the Senate Health and Welfare Committee was huge. We had a few legislators that went in there unsure of how they would vote, but after hearing our well-thought-out and truthful testimony, they knew that voting in our favor was the right call. Our 2/3rds majority vote on the floor shows that our legislators could see through our opposition's scare tactics and lies and knew what optometric scope expansion was in the best interest of Idaho. 


The question now is, do we try again this coming session? We have made some incredible gains with our relationships with legislators that would theoretically make this an almost sure thing if we can get past the Moyle hurtle. I think the next step largely depends on whether or not we can trust him not to kill the bill next year, something he has said he will not do (election year and all that). 



I am so thankful that Dr. Adams has so graciously agreed to take charge as the new legislative chair next year. I will be there to help him, but as I promised, this was my last attempt leading the charge. I think fresh energy and less frustration are exactly what we need.

Federal Trade Commission Eyeglass Rule


  • The FTC recently sent letters to some offices reporting violations of the eyeglass prescription rule.
  • Here is a link to the official FTC rule: Complying with the Eyeglass Rule | Federal Trade Commission (ftc.gov).
  • There are proposed changes to this rule, which would require offices to document that patients have received a copy of their spectacles Rx (similar to the FTC contact lens Rx rule). 
  • The AOA and many other organizations are fighting against this update. 


DEA License Renewal


  • Congress passed legislation requiring a one-time, eight-hour training for all Drug Enforcement Administration (DEA)-registered practitioners on treating and managing patients with opioid or other substance use disorders.
  • Anyone renewing after June 21, 2023 will be required to attest to having taken this additional training as part of their DEA application or renewal. Doctors have to renew their DEA license every three years. There are currently several free courses available online that will meet the requirements. 
  • These courses will count toward your annual Idaho CE requirements. Nine of the 18 required credit hours may be obtained through asynchronous courses; online, periodical, recorded lecture, etc.

Greetings from the Idaho Board of Optometry,


We’ve completed our work on Zero Based Regulations as directed by Governor Brad Little. The results of this work are cleaner, easier to read chapters within our Rules. The updated Rules should be available shortly for you to read. 


Also in the works are updated forms for license applications, license renewals, and annual audits. The new forms will be easier to follow and will be coming in July 2023. As a reminder, carryover hours have gone away effective 2023. Starting this year, you must complete all of your CE in the same year. 


As we are at the end of our fiscal year, we also selected a new Chair, Jared Walker, OD. He will be taking the helm effective July 1, 2023.


Lastly, online license renewals are coming your way!!! We are still months away from completion, but it will happen.

Since our last newsletter, IOP communication committee discontinued its online marketing campaign designed to get our message out to the public during the past legislative session. Although we have discontinued this campaign, our website remains up and active (www.accesseyedaho.com).


We are currently working on our outreach strategy and plan to communicate with our membership body. If you have any knowledge of digital/social media and are interested in helping the IOP use those resources more efficiently, please email or reach out to the any member of the executive committee.

Hello and Happy Summer!


Mid-June, I will be venturing over to Washington DC to scout a new speaker for 2024’s Annual Congress. Optometry’s Meeting has been where previous favorite speakers have been discovered - I, too, am presenting as a speaker - so wish me luck! 

   

Registration is open for this year’s Congress, don’t miss out on early registration pricing! CE is available for every class in some fashion for those looking to maintain their certifications. 

   

If you didn’t attend Congress in 2017, Mary Schmidt will be a returning speaker, starting the two days of classes on reminders of how our offices can potentially lose patients, team building, leadership, and triage. Mary will also educate the techs on the second day about anatomy and then address both classes about the professional aspect of your career as a Paraoptometric. I’ll also be jumping in as a speaker on the technician side to go over tools/testing used in an exam, medications that can affect the eyes (it’s actually a ton of them), and a class dedicated to glaucoma.

   

I’m excited for the true two-track system - opticians will meet Cira Collins, who has put together a great lineup and even created a class specifically for us based on last year’s surveys. Cira’s classes will include frame styling (with science), lens colors, how to pick a quality frame line for your office, a more advanced class on frame adjusting, plus, as mentioned by special request, a class on an appropriate and successful “script” to use for selling.


I hope to see many of you in Boise this October!

Final Comments


One of the ways our IOP association is financially viable is with the many sponsors and vendors at Congress. 


Hollingshead Barrett Eye Center and Pacific Cataract + Laser Institute have once again sponsored at our highest Platinum level! Vision Quest is again a Silver level sponsor this year, along with VSP and LaFont. In addition, we have an educational grant from MacuHealth, and I will be adding more sponsors to the list in the coming months. We appreciate their continued financial support!  


Along with our sponsors, we will have over 30 vendors in our Exhibit Hall on Friday, October 6th, from 9am-2pm. I'm excited to announce that we will be raffling prizes from our vendors!


Lastly, Lisa and I invite you to mingle with the vendors at our Thursday night Vendor Reception on October 5th at 5pm. This is a great opportunity to meet new vendors, catch up with sales reps you haven't seen for awhile, and chat with those you see often. You can then view their products at their individual booths in the exhibit hall the next day.
