INCOMPAS Joins Other Trade Associations to Urge House

Leaders to Consider American Broadband Deployment Act

INCOMPAS and 10 other industry associations sent a letter to Reps. Mike Johnson (R-LA) and Hakeem Jeffries (D-NY) urging them to prioritize consideration of H.R. 3557, the American Broadband Deployment Act, in the final months of this Congress.


The associations said achieving the goal of universal connectivity will be limited unless certain barriers are removed today and H.R. 3557 would address these barriers. They also said ABDA would ensure continued equitable access to rights-of-way, a key area of deployment for state-of-the-art wireline infrastructure such as fiber, cable, small cell antennas and power transmission, which delivers broadband and other services. Additionally, they said beyond codifying FCC orders on broadband deployment, ABDA takes proactive steps to improve siting on federal lands and reduce unnecessary red tape for applications to deploy or improve communications networks.


“Consumers and small businesses across the country rely on the seamless and speedy deployment of fiber and wireless networks for their broadband connectivity.” said INCOMPAS President Angie Kronenberg. “It is of the upmost importance that every American has access to broadband infrastructure, giving them increased accessibility to healthcare, education, and jobs.”


“Now is the time for Congress to pass the American Broadband Deployment Act," she added. "Broadband is a critical component of participating in the modern economy and touches every economic sector. Passing the legislation would be a key step in closing the digital divide and granting every American reliable and timely access to broadband in both metropolitan and rural areas across the country.”

INCOMPAS Participates In and Supports Local Permitting Report

The Benton Institute for Broadband and Society published a report – Permitting Success – Closing the Digital Divide Through Local Broadband Permitting – which is intended to help local governments and internet service providers (ISPs) develop permitting processes that will maximize the impact of BEAD and all future investments in broadband to help ensure that every community in America receives the full benefits of modern connectivity.


The report has several recommendations for local governments and ISPs on fostering partnerships through communications, how to maximize limited resources, and how to improve processes through transparency. Finally, it also offers several successful case studies that may prove useful in other local jurisdictions.


"By developing effective and efficient permitting processes, and working in a collaborative fashion, broadband infrastructure companies and local governments can help ensure that every community in America receives the full benefits of modern broadband connectivity quickly," INCOMPAS President Angie Kronenberg said in a statement. "I was honored to participate in this effort, and I highly recommend that broadband companies and communities use this report as a guide to help achieve their goals of connecting every American to broadband service as quickly and affordably as possible."

INCOMPAS Joins Chamber of Commerce and 70 Other Organizations to Oppose 900 MHz Band Petition at FCC

Highlighting the many current uses in the 900 MHz band, the U.S. Chamber of Commerce sent a letter opposing NextNav's petition in the band to establish a 5G terrestrial-based Positioning, Navigation and Timing network. INCOMPAS and other organizations signing the letter represent a broad cross-section of industry that utilizes the Lower 900 MHz band, and oppose the NextNav Petition due to the likelihood of it causing significant and adverse disruption to the hundreds of millions of Part 15 devices currently using the band.

FCC Announces Tentative Agenda for September Open Meeting

The FCC issued the tentative agenda for its September 26 open meeting, where it will consider:

  • Improving Access to Video Conferencing Services – A Second Report and Order and FNPRM to ensure that people with disabilities can fully participate in video conferencing, including by the use of telecommunications relay services (TRS).
  • Bolstering Protections Against Robocalls and Texts – A Report and Order that would bolster current FCC rules on blocking and robocall mitigation in key areas, including by expanding requirements to block calls based on reasonable do-not-originate lists and by creating new financial penalties for carriers who fail to protect consumers from illegal calls.   • Freeing Up Spectrum to Support Satellite Broadband Service – A Report and Order that will provide 1300 megahertz of spectrum in the 17 GHz band for non-geostationary satellite orbit (NGSO) space stations in the fixed-satellite service (FSS) while also protecting incumbent operations. The Order provides a more cohesive global framework for FSS operators and maximizes the efficient use of the 17 GHz band spectrum.
  • Improving Digital FM Radio Service – A Report and Order implementing a streamlined process for authorizing digital transmissions at different power levels on the upper and lower digital sideband in order to enhance digital FM radio coverage and prevent interference. 


NTIA Seeks Comments on Supporting U.S. Data Center Growth

The NTIA launched an inquiry into how federal policy can support the growth of U.S. data centers to meet the coming demand from artificial intelligence (AI) and other emerging technologies. Data centers are facilities with computing machines that process, store and transmit large amounts of data. Critical and emerging technologies like AI have accelerated demand for the computing and storage infrastructure data centers provide. While there are more than 5,000 data centers in the United States, demand for data centers in the United States is projected to grow by 9% annually through 2030. Read more here.

Hearing Set to Assess BEAD Program Implementation

A subcommittee hearing will be held on Tuesday, September 10, at 10:30 a.m. ET, to evaluate the National Telecommunications and Information Administration’s (NTIA) implementation of the Broadband Equity, Access and Deployment (BEAD) Program. This hearing will serve as an opportunity to hear about how the implementation of the program is going, better understand the impact of NTIA’s rules, and what to expect going forward as states begin to award funds.

Bill Introduced on Interagency Coordination for Broadband Awards

Reps. August Pfluger (R-TX) and Debbie Dingell (D-MI) introduced a bill to improve the mapping process for broadband funding and enhance interagency coordination when awarding broadband funding grants.


The bill would:

  • Improve and align the FCC’s broadband deployment locations map with NTIA’s broadband infrastructure funding database
  • Request non-mandatory reports on state-based programs for inclusion in the NTIA database and FCC map
  • Require other federal agencies to use the new FCC map when awarding broadband infrastructure funding.


Pfluger said there are currently over 130 federal broadband programs across 15 different agencies with little coordination on the billions of dollars being spent.
