Foster Caregivers are Responsible for Keeping Children's Information Confidential

Thank you for the love and support you give to the children in your care! One of the ways you support children in foster care is by keeping their identity and information confidential.


When you sign off on the CLARK COUNTY DEPARTMENT OF FAMILY SERVICES

FOSTER CARE PARTNERSHIP AGREEMENT, you agree to "Keep confidential information given about the children and their families as mandated by NRS Chapter 432B."


When you keep children's information confidential, you are protecting the child, and protecting yourself.


Pursuant to NRS 432B.280 and 290, information maintained by Clark County Family Services is confidential, and the release of that information, outside of prescribed exceptions, is a gross misdemeanor.


Clark County Family Services encourages you to review the NRS 432B.280 Confidentiality of Information Maintained by an agency which provides child welfare services.



NRS 432B.280 Confidentiality of information maintained by an agency which provides child welfare services; exceptions; penalty. Any person, law enforcement agency or public agency, institution or facility who willfully releases or disseminates such information, except:

   (a) Pursuant to a criminal prosecution relating to the abuse or neglect of a child;

   (b) As otherwise authorized pursuant to NRS 432B.165 and 432B.175;

   (c) As otherwise authorized or required pursuant to NRS 432B.290;

   (d) As otherwise authorized or required pursuant to NRS 439.538; or

   (e) As otherwise required pursuant to NRS 432B.513,

is guilty of a gross misdemeanor.)


This is especially important when it comes to sharing your child's information with community organizations or on event registrations that indicate the child is in foster care.


Clark County Family Services understands that there are several agencies who offer services and support for children in foster care. Many of those agencies have formal partnership agreements with Clark County Family Services, but unfortunately some do not.


If you are unsure whether or not the agency is in partnership with Clark County Family Services, please be cautious with providing your children's information such as name, age, birthdate, school, case worker, etc. Providing such information may be in violation with NRS 432B.290 2(e).


You can always reach out to your child's caseworker if you are concerned about any event, service, or registration regarding your children in foster care.
