"Heads Up! Potential Changes To MRTA Affecting All Homeowners Associations Incoming"

Although the next legislative session has not yet started as of the date of writing (note: starts January 9, 2018), bills affecting community associations are often filed months in advance of the start of the session.  We are most closely monitoring, at this time, Senate Bill 266.  Under its initial draft, this bill could substantially change the process by which certain community associations preserve their governing documents pursuant to Florida Statute 712 (the Florida Marketable Record Title Act 'MRTA') and Florida Statute 720 (the Florida Homeowners' Association Act).   This bill, if signed into law as currently drafted, could also place additional burdens on certain community associations to take additional steps and provide additional notices to its owners in compliance with the law.

Need A Space To Have Your Meeting?
 
We bet you have not been taking advantage of a very special service we offer at our Melbourne Office.  Would you like to host a board or membership meeting somewhere else because:
 
  • You would prefer a low key meeting without distractions
  • Would like an attorney present for all or part of the meeting
  • You need a professional setting
 
Well, we have just the solution for you.  Our large Melbourne Conference room located off Wickham Road in the Viera/Suntree area can host up to fifteen people in a professional setting with a screen and projector made available to our clients.  There is plenty of complimentary lighted parking available.  While there is no charge to use the room, there would be a fee for the time that the attorney would be present in the meeting.  When their presence isn't needed, they will retire to another part of the office to work on other matters and you can always call them back in the room if the need arises.
 
This service is especially valuable to our clients if there are sensitive subjects to discuss.  While you can't bar your residents from attending most Association meetings, based on our experience it is rare for residents to attend a meeting at one of our offices.

What is "certification?" All Board Members should take the Board Certification class within 90 days of taking office or complete a sworn affidavit and furnish it to your Association's secretary.  If you would like a copy of the Affidavit, please furnish your name, legal name of Association, and your e-mail address and we will send you the form.  Please let us enjoy the pleasure of your company. Just another way we Embrace Community.
Apopka Residents - Here's An Organization Just For You!
If your community is in Apopka, there is an organization your Association should consider joining - Apopka Area Council of Neighborhoods Associations (AACONA)!  AACONA meets the 2nd Monday each month at the UCF Business Incubator at 325 S. McGee Avenue in Apopka at 7:00 p.m.  The monthly meetings feature guest speakers from the city, county, and/or private industry.  Members have the opportunity to network with other communities and share possible solutions to problems that they are facing. Potential members must be on their current Association Board.

 New Community Association Organizations Forming
 
There are several new organizations for members of HOAs, Condos, Co-Ops, and Mobile Home Park starting their corporate organizational planning in three different areas of Central Florida in the coming months.  They are:

Cities of New Smyrna Beach-Oak Hill-Edgewater-Scottsmoor-Mims
 
These non-profit groups are in the early stages of organizational meetings.  If you currently serve on a Board of Directors for a Community Association, you are eligible for membership.  Want more information? For Community Associations?

Through the years, we have received numerous requests for a set of the Florida Statutes pertaining to Community Associations.  Due to these suggestions, we are now offering the "The Florida Statute Organization Service."  The pertinent Statutes for HOAs, Condos, Co-Ops, and Mobile Home Parks are presented in a binder similar to the featured picture.  Each page is in a sheet protector with tabs separating the various chapters.  The cost of the book is $65.  Each Florida Statue Book is designed just for your type of community association (HOA, Condominium, Cooperative, or Mobile Home Park).
