Thinking about 2012? Get your business in order: Wills and Trusts
During the holiday season, we all think about the end of the current year and the start of a new year. As you think about the coming year, give some careful consideration to creating a will or a living trust or updating your existing will and trust documents. We at the Tarvin Law Firm are ready to assist you with any of the following: Creation of a Will - All persons need a will, regardless of how much property you own. This is especially true when you have children. In a will, you will leave special instructions about who you would want to take care of your minor children in the event of the death of both you and the child's other parent. You will also make decisions about how you want your body to be treated after your death. Also, having a will makes the job of handling your property easier for those who survive you because you will have left instructions and planned thing in advance. You may also need a Living Will to tell your doctor and your family about your "end of life" preferences. Another useful document that you may want us to help you with is the creation of a Durable Power of Attorney. A Durable Power of Attorney allows you to name a third party or parties to help to make your medical and business decisions if you become unable to do so due to your health. Creation of a Living Trust - Some persons may benefit from the creation of a Living Trust. A Living Trust allows your estate to pass at the time of your death without having to file a probate proceeding in the Probate Court. Updating your Existing Will - If you have an existing will, you need to review it and make sure that all of the information is up to date and that the terms of the will are still consistent with your wishes at the time of your death. Problems with other family members might mean you need to revise the terms of the will. Also, adult children may have divorced or may have additional children. These changes in your personal and family relations need to be properly reflected in your will. Updating your Existing Trust - If you have an existing Living Trust, you need to make sure all of the information related to the trust documents is up to date. You need to make sure that the property that you have transferred into the trust is still owned by the trust and that you do not have any newly acquired property that needs to be properly transferred into the trust. Also, as with a will, problems with other family members might mean you need to revise the terms of the trust. Also, adult children may have divorced or may have additional children. These changes in your personal and family relations need to be properly reflected in your trust. Call or email us today to set up a time for a consulation concerning the creation and updating of your Will or Living Trust. Traffic Tickets that "matter", Speeding Tickets and DWI
At Tarvin Law Firm, we provide legal defense services for people who have been charged with crimes or offenses by the State. While most of us seldom find ourselves in serious criminal trouble, it is hard for most of us to avoid getting a traffic ticket from time to time. Most of the time, automobile related criminal charges are just "a ticket" and we just pay it. On the other hand, there are times when even a "minor" traffic charge can have serious consequences. If you have a CDL drivers license, most any traffic ticket you receive counts "points" against your driving record. This is true whether the traffic offense happens on the job or off. If driving is part of your job, even if you do not have a CDL, employers often check on your driving records because they usually carry insurance that covers your driving on the job. If you know someone who happens to be stopped for DWI or DUI, this is always a serious matter. If you or someone you know has a traffic ticket that may mean serious consequences, it is a good idea to consult with an attorney before appearing in court or pleading guilty to the charge. If you, a family member, friend, or a co-worker needs assistance with a traffic ticket or other criminal charge, contact us for a consultation. Our phone number is 479.273.5336 and you can reach legal assistant, Kathleen Mulcahy at kathleen.mulcahy@tarvinlawfirm.com.
