PEO BISON WORKFORCE IS GORED


On March 2, 2023 in LA Superior Court, Bison Workforce Solutions owner Wesley Owens and his sales associate Beau Wilson pleaded "no contest" to multiple felony counts of insurance fraud. The scam by the Georgia-based Bison was to agree in handling workers' compensation insurance related services for PEO customers, pocket the money intended to purchase workers' compensation insurance, and then issue fake Certificates of Liability Insurance to fool their clients who though insurance had been obtained.


In California, the WCAB Boards have been packed with cases involving Bison's scam against PEOs like BaronHR and others. As a result, injured workers spent years fighting to receive benefits, and unsuspecting special employers and their carriers found themselves liable for providing benefits under the general-special employer liability doctrine.


Owens and Wilson must each pay $350,000 before final sentencing on 9/13/2023, where it's expected they will receive 10 years of formal probation and ordered to pay $14.15 million in restitution.

[COMMENT: Another example of why "Certificates of Liability Insurance" should not be accepted on their face, with a demand made for a copy of the policy w/endorsement and proof of coverage w/WCIRB.]

WCAB RESCINDS COVID RULES


On March 22, 2023 the WCAB confirmed the last remaining special COVID-19 practice and procedure rules were rescinded which include:

1) C&R WITNESSES: CCR 10500(b)(6) is no longer suspended which means witness signatures are again required on C&Rs;

2) E-FILING: CCR 10940(b) is no longer suspended which means documents can again be filed by fax or e-mail if ordered; and

3) WALK -THROUGH: CCR 10789(c) is no longer suspended, which means a return to the walk-through procedures for settlement documents and petitions for attorney fees, costs and compel attendance at medical exams, as well as back to walk-through hours of 8am to 11am, and 1pm to 4pm on court days.


[COMMENT: These changes do not impact the other COVID-era rules which have become permanently adopted such as teleconferences and tele-health exams.]




UPCOMING CSIA CONFERENCE


The 2023 California Self-Insurers Association Annual Meeting and Educational Conference is set for May 15-16, 2023 at the Disneyland Hotel in Anaheim.


At the CSIA conference, HEWS President and Senior Managing Attorney H. Neal Wells IV will be a featured panel speaker the afternoon of May 15th. Wells and the panel will be discussing a variety of cost-saving measures when handling litigated workers' compensation cases.
