Connecticut Modifies Non-Compete Law for Physicians, and Extends Protections to APRN’s and PA’s


Effective July 1, 2023, CT Public Act 23-97 modifies Connecticut’s non-competition statute in several ways. The new law amends how, when, and in what situations non-compete clauses may be used in employment agreements with physicians, APRN’s, and PA’s. The law clarifies, when applicable, the geographical restriction. The size and type of the medical employer also matters for physicians. Click here for information from the association’s general counsel, Garfunkel Wild, PC.


In a tangentially related matter, the National Labor Relations Board (NLRB) issued a decision that held the inclusion of broad non-disparagement and confidentiality provisions in severance agreements is unlawful.

Telehealth and Termination of the Public Health Emergency


In March 2020, Governor Ned Lamont signed an emergency waiver relaxing state telehealth regulation to enable more people to receive medical care from their homes. One measure prohibited commercial insurance carriers from reducing reimbursement for services because they were provided through telehealth instead of in-person. Last year, the legislature passed a law extending the telehealth provisions through June 30, 2024. For now, Medicaid will continue to reimburse equally for telehealth according to the Department of Social Services. The federal government extended most of the telehealth waivers for Medicare through December 31, 2024.
