Notable Projects Through the Years:
Construction Consulting at Silver Spring Transit Center
HAWK expertise led to a favorable outcome for our client.

Montgomery County, Maryland, engaged GREYHAWK to analyze the delay and direct cost damages resulting from the actions or failings of several participants in the Silver Spring Transit Center project. GREYHAWK’s delay and damages analysis, and expert testimony, led to a favorable outcome for our client.

In April 2004, Montgomery County entered into a contract for design of the Silver Spring Transit Center, a new three-level, 30-bay bus terminal adjacent to the Maryland Area Rail Commuter (MARC) train and Washington Metropolitan Area Transit Authority rail station in Silver Spring, Maryland, an immediate suburb of Washington, D.C. In September 2008, the county entered into a $66 million contract for construction of the new transit center. The construction contract called for substantial completion to occur on August 10, 2010.

Early project delays during site work, excavation, and foundation activities resulted in a 447-calendar-day time extension and a new substantial completion date of October 31, 2011. However, delays continued to be experienced, chiefly as a result of issues affecting superstructure elements including concrete deck slabs, beams, and girders. The investigation, remedial designs, and repairs of these issues resulted in an additional delay of four years. The project did not achieve substantial completion until August 12, 2015, five years after the original completion date.

Montgomery County hired GREYHAWK to analyze critical project delays and determine the extent of, and allocate responsibility for, those delays. GREYHAWK was also asked to determine the additional costs resulting from the delays, any design or construction deficiencies, and the remedial actions to correct those deficiencies. GREYHAWK coordinated its analysis with those of other experts engaged on behalf of the county. GREYHAWK reviewed county cost records, created a detailed daily as-built schedule, established the as-built critical path to project completion, and quantified critical delays. GREYHAWK issued affirmative, rebuttal, and responsive reports relative to both delay and damages, and provided litigation support. Ultimately, GREYHAWK provided expert testimony in deposition and court leading to a favorable settlement prior to completion of the jury trial, and thereby mitigating further trial expenses for all parties.
