Judges and retired judges may know more about the shortcomings of criminal law than almost anyone. Yes, sitting judges are significantly restricted from advocating publicly regarding those flaws. Retired judges and justices, however, aren't. They should therefore inform the public if they see the law wanting. (Retired) Justice Breyer, too!
