"Thank you to the Eastpointe Police Department, and the St. Clair County SWAT team for all their hard work in investigating and taking this family into custody. This shooting endangered the lives of both adults and children in our community, and we will see that these actions have serious consequences. Such disregard for human life cannot and will not be tolerated," said Macomb County Prosecutor Peter J. Lucido.
Tyler Fistler, age 21 of Casco, was arraigned on the following charges:
Count 1: Assault with Intent to Murder, a life felony
Count 2: Assault with Intent to Murder, a life felony
Count 3: Using a Computer to Commit a Crime, a 20 year felony
Count 4: Tampering with Evidence, a ten year felony
Count 5: Discharge of a Firearm from a Vehicle, a ten year felony
Count 6: Discharge of a Firearm at a Building, a ten year felony
Count 7: Carrying a Concealed Weapon, a five year felony
Count 8: Felony Firearm, a two year mandatory felony
Count 9: Malicious Use of a Telecommunications Services, a six month misdemeanor
Tyler Fistler was arraigned in Eastpointe District Court where Magistrate Mark Makowski set bond at $1 million cash/surety with bond conditions that he must get a mental health assessment, have no contact with the victim or location of the crime, no internet, a GPS tether, and no weapons.
Derek Morris, age 51 of Port Huron, was arraigned on the following charges:
Count 1: Conspiracy to Commit Assault with Intent to Murder, a life felony
Count 2: Conspiracy to Commit Assault with Intent to Murder, a life felony
Count 3: Accessory After the Fact to a Felony, a five year felony
Count 4: Lying to a Police Officer during a Violent Crime Investigation, a four year felony
Count 5: Computer/Internet - Communicating with Another to Commit a Crime, a one year misdemeanor
Count 6: Malicious use of a Telecommunication Device, a six month misdemeanor
