Son, Father and Grandmother Arraigned in Connection with an Eastpointe Drive By Shooting

Mount Clemens, MI - Three family members have been charged and arraigned in connection with a drive by shooting in Eastpointe.

It is alleged that on Tuesday, June 25, 2024, Tyler Fistler and his father Derek Morris carried out their previous online threats by shooting at an Eastpointe residence from a vehicle. No one was injured in the shooting. When officers arrived at Fistler's Casco residence, Fistler was holding a firearm as he and Derek Morris entered the home and refused to come out. St. Clair County SWAT attempted to call the men out, but they did not comply. SWAT then deployed gas cartridges into the home, prompting Fistler and Morris to exit. They were arrested. Further investigation led to the discovery of the vehicle involved in the drive-by shooting at Morris's mother's residence. Later that day, during a jail call, Derek Morris asked his mother, Jaraldine Morris, to dispose of evidence at her house, and she agreed.

"Thank you to the Eastpointe Police Department, and the St. Clair County SWAT team for all their hard work in investigating and taking this family into custody. This shooting endangered the lives of both adults and children in our community, and we will see that these actions have serious consequences. Such disregard for human life cannot and will not be tolerated," said Macomb County Prosecutor Peter J. Lucido.

Tyler Fistler, age 21 of Casco, was arraigned on the following charges:

Count 1: Assault with Intent to Murder, a life felony

Count 2: Assault with Intent to Murder, a life felony

Count 3: Using a Computer to Commit a Crime, a 20 year felony

Count 4: Tampering with Evidence, a ten year felony

Count 5: Discharge of a Firearm from a Vehicle, a ten year felony

Count 6: Discharge of a Firearm at a Building, a ten year felony

Count 7: Carrying a Concealed Weapon, a five year felony

Count 8: Felony Firearm, a two year mandatory felony

Count 9: Malicious Use of a Telecommunications Services, a six month misdemeanor

Tyler Fistler was arraigned in Eastpointe District Court where Magistrate Mark Makowski set bond at $1 million cash/surety with bond conditions that he must get a mental health assessment, have no contact with the victim or location of the crime, no internet, a GPS tether, and no weapons.

Derek Morris, age 51 of Port Huron, was arraigned on the following charges: 

Count 1: Conspiracy to Commit Assault with Intent to Murder, a life felony

Count 2: Conspiracy to Commit Assault with Intent to Murder, a life felony

Count 3: Accessory After the Fact to a Felony, a five year felony

Count 4: Lying to a Police Officer during a Violent Crime Investigation, a four year felony

Count 5: Computer/Internet - Communicating with Another to Commit a Crime, a one year misdemeanor

Count 6: Malicious use of a Telecommunication Device, a six month misdemeanor

Derek Morris was arraigned in Eastpointe District Court where Magistrate Mark Makowski set bond at $500,000 cash/surety with bond conditions that he must get a mental health assessment, have no contact with the victim or location of the crime, no internet, a GPS tether, and no weapons.

Jaraldine Morris, age 81 of Port Huron, was arraigned on the following charges:

Count 1: Tampering with Evidence in a Criminal Case Punishable by more than 10 Years, a ten year felony

Count 2: Accessory After the Fact to a Felony, a five year felony

Count 3: Lying to a Peace Officer in a Violent Crime Investigation, a four year felony

Jaraldine Morris was arraigned in Eastpointe District Court where Magistrate Mark Makowski set bond at $50,000 cash/surety. She was referred to Community Corrections for mental health issues and upon release she must wear a GPS tether.

All three defendants have a Probable Cause Hearing scheduled for Tuesday, July 9, 2024 at 8:00 am in Eastpointe District Court.
