It is illegal to charge an added fee or surcharge on Credit or Debit Card Sales in Massachusetts.
Massachusetts General Laws chapter 140D, section 28A(2) provides that No seller in any retail sales transaction may impose a surcharge on a cardholder who elects to use a credit card in lieu of payment by cash, check or similar means.
You can however offer a CASH Discount but the regulations are strict and confusing and it seems close to skirting the law.
In summary, in the Commonwealth of Massachusetts, a retail buyer cannot be charged extra for using credit, debit, or other means, in lieu of cash.
