Tom Mears of Shore United Bank Promoted to Regional President of Coastal Region

Bank of America Private Bank Market Minute

While the U.S. Equity Indexes are still higher for the year, the S&P 500, Nasdaq, and Dow Jones Industrial Average (Dow) posted losses for Q3 of 2023. The S&P 500 Index closed the month down 4.9% while the Dow and Nasdaq Composite dropped 3.5% and 5.8%, respectively, over September. At last Friday's close, the S&P 500 was down almost 7% from its July 31 peak. As for the 11 major S&P 500 sectors, Utilities lost the most ground by shedding 10% in September while, on the other hand, Energy stocks gained 11%. The yield on the benchmark 10-year U.S. Treasury note traveled above 4.6% last Wednesday—it’s highest since 2007—before ticking lower at the end of last week. U.S. inflation data showed that for August, the Personal Consumption Expenditure (PCE) price index rose 0.4% in August versus 0.2% in June. Its core counterpart (excludes food and energy)—and the Federal Reserve’s (Fed) preferred inflation measure—increased only 0.1% for the month. Housing and gasoline were large contributors to the increase in PCE. Across the Atlantic, Eurozone inflation slowed sharply in September as headline consumer inflation slowed to 4.3% year-over-year (YoY) and the core consumer price index (CPI) slowed to 4.5% YoY. A last-minute bipartisan deal on short-term funding was reached Saturday night, avoiding a government shutdown and kept the government funded until at least November 17. All eyes will be on how markets digest the weekend move, as well as the August jobs report due on Friday.

Webinar: The U.S. Supreme Court’s Decision in CFSA v. CFPB: Who Will Win and What Does It Mean?

October 3, the U.S. Supreme Court held oral argument in Community Financial Services Association of America Ltd. v. Consumer Financial Protection Bureau, a case with profound potential implications for the future of the CFPB. At issue is whether the CFPB’s funding mechanism violates the U.S. Constitution’s Appropriations Clause and, if so, what the appropriate remedy should be. Both sides were subjected to intense questioning during the oral argument, with all of the Justices asking questions.


Our exclusive roundtable brings together six attorneys who filed amicus briefs with the Supreme Court. They will share their reactions to the oral argument, important insights into the thinking of the nine Justices, predictions for how and when the Court will rule, and potential implications for the CFPB, the industry, and consumers.
