Bank of America Private Bank Market Minute

Major indexes locked in gains last week over a busy week of quarterly corporate earnings reports and a Federal Reserve (Fed) policy meeting. The S&P 500 and Dow Jones Industrial Average each logged a third consecutive positive week (1.0% and 0.6% weekly gains, respectively). The Dow last Wednesday clinched a winning streak of 13 trading days—its longest streak since 1987. Once again proving more resilient than expected, the U.S. economy posted a preliminary growth figure of 2.4% for Q2 compared to 2.0% for Q1. Despite higher prices, consumer spending rose by 1.6% in Q2 after rising by 4.2% in Q1. Last Wednesday, the Fed raised interest rates by a widely anticipated quarter percentage point to the highest level in 22 years (the 11th hike since March 2022), bringing the fed funds target rate to 5.25% - 5.50%.

Uncertainty in the energy market in 2022 resulted in elevated volatility in the prices of crude oil and natural gas. Prices for both have cooled off in 2023, and some unanswered questions from last year have been answered this year. However, tightening credit conditions, coupled with sharp monetary policy tightening globally, is putting additional pressure on energy market participants. This energy transition is reshaping the landscape of the energy sector gradually.


This 90-minute Ask the Fed session will include speakers from the Federal Reserve Bank of Dallas’ energy team: SungJe Byun, Senior Economist; Rebin Kawani, Data Scientist; Kunal Patel, Senior Business Economist; and Jesse Thompson, Senior Business Economist.  Overhaul of Regulatory Capital Requirements Proposed by US Banking Regulators

On July 27, 2023, US federal banking regulators issued proposals to (i) significantly revise the risk-based regulatory capital requirements for certain midsize and larger US banking organizations and (ii) change the method for calculating the capital surcharge for globally systemically important banking organizations (“G-SIBs”). These proposals are of critical importance because the amount of capital a bank must maintain with respect to any particular loan, investment or activity is typically a significant – if not the most significant – factor in determining whether the relationship is profitable or even feasible. In this Legal Update, we provide background on the regulatory capital requirements, discuss the two proposals, and highlight a number of the likely potential impacts.

SEC Adopts Final Cybersecurity Rules — Requires Companies to Focus on their Security and Disclosure Plans

On July 26, the Securities and Exchange Commission (SEC) adopted, by a 3-2 margin, a final rule to require more immediate disclosure of material cybersecurity incidents by public companies. In addition, the final rule requires annual disclosure of material information regarding a public company’s cybersecurity risk management strategy and cybersecurity governance. In approving the final rule, SEC Chairman Gary Gensler stated that the final rule will provide investors with more consistent, comparable, and decision-useful tools for analyzing disclosures about cybersecurity incidents. The reality is that the final rule requires public companies to make difficult real-time decisions about whether a cybersecurity incident requires disclosure, all while in the middle of responding to and addressing the actual incident. When a cybersecurity incident inescapably happens, the right information must be reported up the chain to those making disclosure decisions. Public companies should consider identifying gaps in reporting structures and increasing collaboration among security teams and legal counsel.
