The US Federal Maritime Commission (FMC) ruled that liner operators cannot use “business decisions” to refuse moving booked containers, aiding US exporters struggling for shipment space. This decision, part of the Ocean Shipping Reform Act (OSRA), responds to challenges faced during the Covid-19 pandemic. Major carriers like MSC, CMA CGM, and Hapag-Lloyd argue that the ruling undermines business discretion, impacting safety and operations. The FMC aims to prevent carriers from prioritizing profitable cargo, ensuring fairer practices.
