BCC Meeting July 9, 2024


Voted (unanimous): Postpone a decision on the proposed 80.5% increase in Water/Waste Water Impact Fee with suggested potential changes including a three-year phase - in approach as requested by the CBIA leadership.

BCC July 23, 2024


Voted (4-1 in favor, Kowal opposed): Accept the Collier County Water-Sewer District’s Water and Wastewater Impact Fee Study, accept staff’s recommendation to implement a three-year phased approach, and direct the County Attorney to advertise an Ordinance amending the Water and Wastewater Impact Fees, establishing effective dates of December 1, 2024 for Phase One, December 1, 2025 for Phase Two, and December 1, 2026 for Phase Three to include an annual review to determine if changes need to be made.


ADVOCACY ALERT


CBIA LEADERSHIP LOBIED FOR A 3-YEAR PHASE IN APPROACH OF THE PROPOSED 80.5% INCREASE IN WATER/WASTE WATER IMPACT FEES. FHBA HAS IDENTIFIED THIS ISSUE AS A TOP PRIORITY AT THE STATE LEVEL.


Impact Fees and Extraordinary Circumstances: Local governments, school districts, and special districts are only allowed to increase impact fees by an additional 25% in two equal increments after an increase is implemented unless there is an “extraordinary circumstance.” When the use of extraordinary circumstances was introduced, the legislative intent was that it would be used for large growth developments, not “tourism” or other arbitrary reasons unrelated to unique population growth.



FHBA Position: Support legislation limiting the “extraordinary circumstances” exception in the impact fee legislation.

Join the Fight to Rescind Energy Code That Harms Housing Affordability: Now is not the time to create or support additional regulations that add more uncertainty, delays or costs to the home building process. H.J.Res 170 would prevent the U.S. Department of Housing and Urban Development (HUD) and the U.S. Department of Agriculture (USDA) from requiring new homes to be built to the 2021 International Energy Conservation Code (IECC). Home Builders, Developers Score Key Wins in House Passage of Interior-Environment Spending Bill

NAHB and Florida home builders posted key wins after the House passed its Interior, Environment, and Related Agencies Appropriations bill for fiscal year 2025.


The Florida Home Builders Association (FHBA) took the lead in working with NAHB to add an amendment to the spending bill that would codify Florida’s wetlands permitting program. Florida’s Section 404 permitting program under the Clean Water Act (CWA) was granted in 2020 but was divested this year due to a legal case. Read more

NAHB recently released a new mobile tool called the NAHB Jobsite Safety Handbook. The app is available in English and Spanish and features a wide variety of resources for both classroom learning and on-the-job compliance.

  • In a major victory for NAHB and the housing community, the U.S. Supreme Court issued a verdict that cuts back sharply on the power of federal agencies to interpret the laws they administer and ruled that courts should rely on their own interpretation of ambiguous laws. 
  • Last month, more than 900 housing professionals lobbied their members of Congress on important matters to the housing industry, and their efforts during the 2024 NAHB Legislative Conference yielded impressive results on two key issues — energy codes and workforce development.
  • The latest Construction Labor Market Report from the Home Builders Institute (HBI) shows that home builders will need to add 2.2 million new construction workers over the next three years just to keep up with demand.
  • The U.S. Department of Labor’s new rule increasing the salary level for determining overtime pay requirements for certain salaried employees went into effect on July 1. The salary threshold was increased from $35,568 per year to $43,888.
  • A broad coalition of groups representing America’s housing providers, lenders and residents — including NAHB — sent members of Congress and the Biden administration a letter outlining a number of bipartisan policies to address the causes of rising insurance premiums across the nation’s housing market.
