BCC Meeting of November 14, 2023


Voted (unanimous): To approve an Ordinance amending the Collier County Land Development Code, to establish Rules of Decorum related to Neighborhood Information Meetings. (Ordinance 2023-63) for a Land Development Code (LDC) Amendment related to:

 

  • Establish the Rules of Decorum for Neighborhood Information Meetings (NIMs)

  

This Ordinance became effective November 16, 2023. The BCC also adopted a companion item to the ordinance, which includes an amendment to the Collier County Administrative Code for Land Development. (Resolution 2023-211).

Voted (unanimous):To approve an amendment to Resolution No. 2021-193, the Growth Management Community Development Department Services Fee Schedule, with an effective date of January 1, 2024, to comply with Florida Statute Section 553.791, Section 2(b).

Voted (unanimous):To approve an Ordinance amending Ordinance No. 2022-13, the Golden Gate Golf Course Mixed-Use Planned Unit Development (MPUD), by changing the allowed multi-family use on the Residential Tourist (RT) Tract to a maximum of 215 rental units with some affordable housing and to reduce the minimum floor area per multi-family rental dwelling unit to 250 square feet on the RT Tract. The property is located on the southwest corner of Golden Gate Parkway and Collier Boulevard and to approve an Ordinance amending the Government Services, Residential Tourist, and Commercial Sub-district of the Golden Gate City Sub-Element of the Golden Gate Master Plan Element of the Growth Management Plan to limit the uses on the 6.16± acres identified as Parcel 2 by allowing hotel/motel or timeshare or multi-family or commercial uses; and increasing the multi-family use on Parcel 2 to a maximum of 215 rental units with affordable housing.

Voted (unanimous): To approve an ordinance rezoning property from a Rural Agricultural (A) Zoning District with an Airport Zoning Overlay to a Residential Planned Unit Development (RPUD) Zoning District with an Airport Zoning Overlay for a project known as Rock Creek Estates RPUD to allow development of up to 15 unit single-family dwelling units, a private recreational amenity, and a boat ramp with up to 12 private boat slips on property located west of Airport-Pulling Road, on the south side of North Road, across the street from Terminal Drive to the Naples Airport.

Voted (unanimous): To adopt Ordinances amending the Collier County Growth Management Plan relating to affordable housing initiatives, specifically the Future Land Use Element, the Golden Gate Area Master Plan Element, the Immokalee Area Master Plan Element, and the Transportation Element to allow affordable housing by right in certain commercial zoning districts with a sunset date, to allow an increase in density for affordable housing, to establish a Strategic Opportunity Sites Sub-district, and a Transit Oriented Development Sub-district.

December BCC Meeting: December 12, 2023

City of Naples Council Meetings


City Council Meeting of November 15, 2023

Voted (unanimous): A Resolution Relating to a Nonconformity; Determining Petition 23-N2 Pursuant to Sections 46-35(A)(5) and 58-176(3) of the Code of Ordinances for the Vertical and Horizontal Expansion of a Nonconforming Guest House Located in the R1-10 Residence District on Property located at 158 6th Avenue South.

Voted (unanimous): Reinstatement of member removed on October 10 based on ordinance on types of members which should make up composition of Design Review Board. Council discussed staff member - urban planner or architect taking over work of Design Review Board but no action was taken on this suggestion. .


Council Discussed DRB Responsibilities and

Potential Changes to the Process.


At the direction of Mayor Heitmann, council began a discussion on the DRB responsibilities. According to the mayor, preliminary projects need to be previewed by council rather than going directly to DRB. Changes to the DRB process is on the agenda for discussion/potential vote at a special city council meeting on October 30th. On October 30th,the city manager framed the discussion on three major areas. They included (1) DRB process and standards, (2) mass model requirements, and (3) status of DRB Handbook update. City Council directed staff to bring back proposed changes at a future meeting once they have been drafted and reviewed by the city attorney.

Fill Requirements in the City of Naples To Be Determined

on a Case-by-Case Basis Moving Forward


A CBIA Task Force was convened to work with City Building Official, Steve Beckman, to focus on fill requirements in the City of Naples. Based on professional input from our task force members, the City of Naples building department will determine fill requirements on a case–by–case basis moving forward.


Individual determinations will be based upon several criteria including adjacent properties which raised the question of obtaining topographic surveys on these properties. We will work with Steve Beckman and his team to determine a way forward surveying adjacent properties.   

 

Also, another issue brought up in our meetings was the inability for professionals to review elevation certificates.  As shared by Steve Beckman and Bob Dorta, the city is now able to provide elevation certificates on any property within the city through their new program entitled forerunner. Click below for link to forerunner:

Permits are NOT REQUIRED for: Tarping, Painting, Tiling, Carpeting, Minor Removal of Drywall, and Baseboards no more than 4’ above the floor. Roof covering repairs that do not exceed 500 square feet are allowed without a permit.

CBIA partnered with the City of Marco Island and Marco Island Chamber of Commerce for a Builders & Business Owners Roundtable held on 11/02/23. It was a very productive dialogue with suggested changes for improving permitting, and inspections in the building and fire departments. CBIA will keep members informed as to progress. State Legislative Special Session 2023


State legislators approved a hurricane relief bill, signed by Governor DeSantis 111423, which extends the prohibition on burdensome or restrictive local building processes enacted in the 2023 session in response to Hurricanes Ian and Nicole to October 1, 2026, and specifies that such restrictions apply to certain counties and the municipalities including Collier County and cities of Naples and Marco Island.

Collier County Public School District is currently developing a “Community Selection Workgroup” to help with some upcoming projects the schools have including – remodeling a high school gym and cafeteria as well as construction of a new Elementary School. The Selection Workgroup could use 5 more representatives from people experienced in the fields of architecture, engineering and/or construction. It’s a voluntary position and a minimal time commitment to help shape the future of facilities in our district.
