BCC Meeting of January 9, 2024


Voted: (unanimous) To accept the staff summary for the 2024 Southwest Florida Coastal Flood Study (SWFL-CF) edition of the Federal Emergency Management Agency (FEMA) Digital Flood Insurance Rate Map (DFIRM) for Collier County.


Voted (unanimous) To approve a rezoning Ordinance for the 12425 Union Road RPUD to allow up to 109 residential dwelling units on 51.5± acres of property located in Port of the Islands.



BCC Meeting of January 23, 2024


Agenda item to implement a twelve-month moratorium on privately-initiated Growth Management Plan amendment applications for properties located adjacent to (1) Immokalee Road from I-75 east to Oil Well Road, and (2) Vanderbilt Beach Road from I-75 east to its end, while Growth Management Plan amendments are vetted with the public and advisory boards was discussed followed by a motion from Commissioner Saunders which died with no second.


Voted (unanimous) To have staff research various traffic-related ideas with associated costs presented by staff and the public and bring back to a BCC meeting for potential implementation.

City Council Meeting of January 11, 2024


Voted (unanimous): Not to replace Mike McCabe on the Council for the meetings leading up to March 19, 2024 council/mayoral election.


Voted (unanimous): Ordinance to Update the Effective FEMA Flood Insurance Rate Maps (FIRMs) and Flood Insurance Study (FIS) Report.


Voted (In Support: Council members Blankenship, Perry, Petrunoff, Heitman. Opposed: Hutchison. Christman was recused from vote.) First reading of an ordinance for the Purpose of Determining Rezone Petition to Rezone Approximately 13.72 Acres from the "M", Medical District, to the "PS", Public Service District, Pursuant to Section 46-32 of the Code of Ordinances of the City of Naples, for a Portion of the Property Located at 350 7th Street North, Owned by Naples Community Hospital, Inc.

Council Discussed DRB Responsibilities and

Potential Changes to the Process


At the direction of Mayor Heitmann, council began a discussion on the DRB responsibilities in 2023. According to the mayor, preliminary projects need to be previewed by council rather than going directly to DRB. On October 30th,the city manager framed the discussion on three major areas. They included (1) DRB process and standards, (2) mass model requirements, and (3) status of DRB Handbook update. City Council directed staff to bring back proposed changes at a future meeting once they have been drafted and reviewed by the city attorney. No meeting dates has been set.

Fill Requirements in the City of Naples To Be Determined

on a Case-by-Case Basis Moving Forward


A CBIA Task Force was convened to work with City Building Official, Steve Beckman, to focus on fill requirements in the City of Naples. Based on professional input from our task force members, the City of Naples building department will determine fill requirements on a case–by–case basis moving forward.


Individual determinations will be based upon several criteria including adjacent properties which raised the question of obtaining topographic surveys on these properties. We will work with Steve Beckman and his team to determine a way forward surveying adjacent properties.   

 

Also, another issue brought up in our meetings was the inability for professionals to review elevation certificates.  As shared by Steve Beckman and Bob Dorta, the city is now able to provide elevation certificates on any property within the city through their new program entitled forerunner. Click below for link to forerunner:

Voted (unanimous): First Reading of proposed ordinance implementing changes to the Land Development Code (LDC) resulting from the new Flood Insurance Rate Maps (FIRM) issued by FEMA (Federal Emergency Management Agency) and consistent with the language of the State of Florida model ordinance.


City of Marco Island Meeting of January 22, 2023

CBIA partnered with the City of Marco Island and Marco Island Chamber of Commerce for a Builders & Business Owners Roundtable held on 11/02/23. It was a very productive dialogue with suggested changes for improving permitting, and inspections in the building and fire departments. CBIA will keep members informed as to progress. CBIA is working on potential 2024 dates for BRT's with Marco Island staff and will provide to members once finalized.

FHBA Priority Bills Moving in Week 4 

 

SB 1706 "Condominiums Within a Portion of a Building or Within a Multiuse Building"- One of FHBA's top priorities this session, this bill addresses the Icon Brickell case. Sponsored by 2023 FHBA Champion of Housing, Senator Yarborough, the bill will make its first committee stop Feb. 5 in the Regulated Industries Committee. 


HB479 / SB 688 "Alternative Mobility Funding Systems"- Another FHBA priority, this legislation ensures that multiple impact fees are not charged for the same project. Both the House and Senate versions of the bill were heard this week with HB 479 passing favorably out of the House Commerce Committee on Tuesday, Jan 30 and SB 688 passing favorably the same afternoon in Senate Transportation Committee. 


HB 1073 "Mitigation" - This would allow private entities to purchase water enhancement credits or storm water credits. This would also allow for a public-private partnership to build mitigation banks on public and private lands owned by a local government and those mitigation credits would be able to be purchased by private applicants. The bill passed out of the House Water Quality, Supply and Treatment Subcommittee on Jan. 29 and now moves to the House Agriculture and Natural Resources Appropriations Subcommittee on Monday, Feb. 5.


HB 7053 "Ratification of the Department of Environmental Protection’s Rules Relating to Storm Water" – FHBA continues to work with both the House and the Senate, as well as the DEP, in regards to ratifying this rule. The bill was passed by the House Water Quality, Supply, and Treatment Subcommittee on Jan. 29 and has bee referred to the Infrastructure Strategies Committee. 


SB 966 "Home Warranty Transfers"- FHBA continues to work with the House and Senate sponsors on this bill of concern. The Senate Commerce and Tourism Committee will take the bill up on on Tuesday, Feb. 6.


SB 328 "Affordable Housing" – This bill enhancement from last year’s affordable housing champion bill will be heard in Senate Floor for vote on Wednesday, Feb. 7.


SB1492 – "Employment Regulations" – The Senate version of the Heat Preemption bill will be heard in the Community Affairs Community on Wednesday, Feb. 7.


SB 460 / HB 917 – "Career and Technical Education" – These bills, which will allow 16- and 17-year-olds to gain valuable experience on construction jobsites are both expected to be heard next week with the House bill's next stop being the Higher Education Appropriations Subcommittee and the Senate bill headed to the Appropriations on Education Committee.

Higher Fines for OSHA Violations in Effect for 2024

Violations of safety rules on jobsites are now more expensive as the Labor Department announced its annual cost-of-living adjustments to OSHA civil penalties for 2024. The new penalty amounts went into effect Monday, Jan. 15.

OSHA’s maximum penalties for violations will increase from $15,625 per violation to $16,131 per violation. The maximum penalty for willful or repeated violations will increase from $156,259 per violation to $161,323 per violation.

The increases represent an annual increase of around 3.2% from 2023 to 2024, a far cry from the 7.7% increase OSHA announced in penalty increases from 2022 to 2023. The penalty increases are tied to the annual cost-of-living increases across the federal government and to inflation.
