COBI WASTE REDUCTION 2023: TEMPORARY EXEMPTION ITEMS ANNOUNCED, 25-CENT FEE ON DISPOSABLE CUPS
|
In November 2021, City Council adopted new regulations to reduce single-use plastic waste, effective January 1, 2023.
These regulations are intended to reduce waste in our environment and litter in the ocean, protect public health, and reduce our dependence on plastic.
COBI's new regulations to reduce singe-use waste effective on January 1, 2023 include:
- a 25-cent fee for disposable cups is required
- disposable plastic food service ware is prohibited
- reusable food service ware is required for on-site dining
- disposable food service ware is required to be home compostable*
- expanded polystyrene-based food service ware (all plastics #6 and Styrofoam) for prepared food is prohibited
- the distribution of single-use personal care products not packaged in “home compostable packaging” is prohibited in lodging establishments
- the use of refillable dispensers for personal care products is encouraged in lodging establishment
*NOTE: All businesses have been granted a 3-month grace period to use up their existing supplies of non-home compostable food and beverage packaging for to-go orders (through March 31, 2023).
The following products have been granted a temporary exemption through December 31, 2023, due to lack of availability:
- Plastic to-go beverage container lids (hot and cold)
- Bottled juice/beverage containers (made onsite)
- Plastic rotisserie dome containers
- Clear plastic lids for sandwich trays
- Clear plastic sushi tray lids
- Clear plastic salad containers
- Film cling (like Saran Wrap)
- Chocolate boxes and dividers
- Clear plastic cups for cold beverages
- Small paper pastry bags
- Clear plastic confection bags
- Plastic bags for transporting soups and other hot/wet foods and liquids (i.e., placing plastic bags around home compostable soup containers for transport)
- Clear plastic lids for portion cups (please note that home compostable options are available if you do not need a clear lid)

WA STATE LAWS GO INTO EFFECT 2023
|
|
|
Washington will have the highest state minimum wage in the country in 2023 when it increases nearly 9% to $15.74 an hour, for workers age 16 and older.
The state's 2022 minimum wage was $14.49 an hour - that's an increase of $1.25.
Under state law, 14 and 15-year-olds can be paid 85% which will be $13.38 in 2023.

Businesses with at least 15 employees will need to include the following on each job posting or advertisement:
- Salary range or pay scale
- General description of all benefits offered
- Identify any other compensation
|

L&I APPROVED AVER. 4.8% WORKERS' COMP INCREASE
|
The Washington Department of Labor & Industries has confirmed that it will increase workers’ compensation rates an average of 4.8% next year.
|
|
|
|
Drivers for services like Uber and Lyft will have the right to minimum trip pay, paid sick time, workers’ compensation coverage, and protection from retaliation for exercising these rights.
|
|
|
|
OVERTIME EXEMPT SALARY THRESHOLD
|
L&I explains "To be exempt from the state Minimum Wage Act, executive, administrative, professional or computer professional, and outside salespeople must earn at least the minimum salary."
"For employers with 50 or fewer employees, the 2023 salary threshold is 1.75 times the minimum wage: $1,101.80/week ($57,293.60/year). For employers with 51 or more employees, the threshold is double the minimum wage, $1,259.20/week ($65,478.40/year)."

AGRICULTURAL OVERTIME PAY
|
Agricultural workers will need to work fewer hours to be eligible for overtime pay.
In 2023, ag workers will need to work 48 hours before they start earning overtime. In 2024, overtime eligibility begins when a worker reaches 40 hours in a week.

|
IRS DELAYING REQUIREMENT REPORTING $600 IN GIG WORK ON TAXES
|
The IRS said it is delaying a controversial requirement by one year that would have led to more online sellers and gig workers having income reported to the nation's tax agency.
The rule change would have required payment platforms such as Venmo, Paypal or Cash App to send tax forms called 1099-Ks to anyone receiving over $600.
Previously, such payment services only had to report users' income to the Internal Revenue Service if they had more than 200 transactions, exceeding $20,000 in revenue.

NEW RETIREMENT BILL MEANS BIG CHANGES FOR RETIREMENT SAVINGS IN 2023
|
The changes, part of the Secure Act 2.0, were included in the sweeping end-of-year $1.7 trillion spending bill the Senate passed on December 15.
Some changes include:
- Allowing companies to contribute to 401(k) plans for an employee making student debt payments
- 73 is the new age when you're required to begin taking the minimum distribution from a tax-advantaged retirement savings account - in 2033 it will move up to age 75
- If your employer has a 401(k) or 403(b) retirement savings plan, you will be automatically enrolled once you're eligible
- A 10% tax will be paid if you withdraw money from a tax-preferred retirement account before you turn 59½ unless you satisfy an exemption
- Leftover funds in a 529 account can be rolled over - up to $35,000 - into a Roth IRA account without facing penalties
