Happy Summer! Hope everyone is enjoying a busy, and enjoyable season on your coast. Here in DC, Congress is busy – while not necessarily completing anything, we’re seeing hearings and committee mark-ups on appropriations and legislation including the Resilient Coasts & Estuaries Act and WRDA. Within agencies we’re still seeing rules and guidance come out, and we’re anticipating the announcements for NOAA’s biggest funding for coastal resilience and habitat restoration (could be anytime or not till end of summer).

Action Requests

Preparing for Summer Congressional Visits

With summer's arrival, it is time to start thinking about teeing up Congressional visits for the August Recess. With members and staff in their home states and districts in August it is an excellent time to consider getting them out into the field to see firsthand the incredible work being done by Coastal Zone Management programs. 

 

These experiences are one of the best ways for members and staff to understand and build a connection to the tangible benefits of investing in coastal zone management, estuaries, coastal infrastructure and more. Having these connections to draw on are extremely important when it comes time for them to vote on the next appropriations bill, supplemental funding or relevant legislation, such as the Resilient Coasts and Estuaries Act (CELCP and NERRS reauthorization). 

 

Projects that are breaking ground (including BIL / IRA projects) or those that have been recently completed are great opportunities for visits. However, anything that gets members out to the coast can provide a venue for discussions on the importance of coastal zone management.

CZM non-competitive “capacity” funding for BIL years 3, 4, & 5 (totaling $900K, or $300K/yr, per CZM Program). Due in draft to NOAA on Tuesday July 2, 2024, and due in Grants.gov on Friday July 26, 2024.

 

CZM competitive BIL Year 3 ($44.6 million); Letters of Intent due Thursday August 15, 2024 (full application will be Jan 9, 2025)

This funding opportunity is a NOFO for the Environmental and Climate Justice Community Change Grant Programs from the EPA. The grant program offers $2 billion to benefit disadvantaged communities through “projects that reduce pollution, increase community climate resilience, and build community capacity to address environmental and climate justice challenges.” States are not directly eligible, but any underserved community-based non-profit organizations (CBOs) and/or community is likely eligible. EPA is specifically interested in funding Territories! It's a rolling application for a year (closing on Thursday November 21, 2024) and allows for the potential resubmission of initially unsuccessful applications.

Hill Updates

Resilient Coasts and Estuaries Act Hearing: On June 27, the Water, Wildlife and Fisheries subcommittee of the House Natural Resources Committee held a hearing on the Resilient Coasts and Estuaries Act. The bill was one of 4 bills included in the hearing, with the others being a bipartisan bill on data / mapping of the ocean and more contentious bills regarding use of federal fishery data and vessel speed restrictions relating to the North Atlantic Right Whale. Much of the hearing testimony and questions related to these later two bills. However, Rep. Levin, the bill's lead sponsor, spoke out in favor of the bill, as did Rep. Huffman and Rep. Magaziner.  


Ahead of the hearing, CSO coordinated a sign-on letter in support of advancing the legislation which garnered 19 signers from various coastal and conservation organizations and complimented a support letter spearheaded by the Theodore Roosevelt Conservation Partnership from hunters and anglers that included an additional 17 organizations. 


Hopefully, this hearing not only clears the way for the bill to move to a markup in the House, but also helps to spur action from the Senate and move them towards a bill introduction. 


CJS Appropriations Updates: The House Commerce, Justice and Science subcommittee released their FY 2025 bill this week and held its markup on Wednesday, June 26th. There has been very little discussion on the Hill regarding the NOAA components of the bill (NOAA did take a sizeable cut of more than $600M), as much of the focus has been on controversial cuts and policy riders tied to the Department of Justice. 


 As with other bills, there was little action in the subcommittee mark up and report language detailing the funding breakdown for the National Ocean Service. These details should be released prior to the full committee markup in the coming weeks and CSO will distribute an analysis when this information is available. A full committee markup has not yet been scheduled. 

 

On the Senate side, Chairwoman Murray has announced her intention to release bills and begin holding markups following the July 4th recess. At this point, we anticipate these will be partisan bills and markups. 


House Water Resources Development Act (WRDA) bill approved: The House Transportation and Infrastructure Committee was released and approved on June 26th. As expected much of the bill is focused on specific projects. CSO will be reviewing legislative details in the coming days.

[NEW] Wetland Protection Resources

Two recent resources have been released tracking post-Sacket federal and state wetlands / water quality protections. Sackett v. EPA: The State of Our Waters One Year Later by Clean Water for All provides a report and map of the state of clean water protections. Layers for Good Government have posted a new Wetlands Dashboard that provides state profiles tracking definitions of “waters of the state” and “wetlands” and existing and proposed wetland protections. The NFIP/CRS Update is a bimonthly newsletter published by ISO containing news about new developments and products, upcoming events, management tips, and training and event listings. [NEW] FEMA Requests Public Comments on Latest Public Assistance Program and Policy Guide

FEMA is requesting public comments on the latest Public Assistance Program and Policy Guide (PAPPG, Version 5), which focuses on plain language and increased eligibility for assistance. Comments should be submitted via regulations.gov by Monday, August 19, 2024. [NEW] FACT SHEET: Biden-Harris Administration Releases Agency Climate Adaptation Plans, Demonstrates Leadership in Building Climate Resilience

The Biden-Harris Administration released updated Climate Adaptation Plans developed by more than 20 federal agencies that expand agency efforts to ensure their facilities, employees, resources, and operations are increasingly resilient to climate change impacts like extreme weather. This work advances the Biden-Harris Administration’s National Climate Resilience Framework, which helps to align climate resilience investments across the public and private sector through common principles and opportunities for action to build a climate-resilient nation. These efforts are backed by President Biden’s Investing in America agenda, through which more than $50 billion is being delivered to advance climate adaptation and resilience across the nation, including in communities that are the most vulnerable to climate impacts. [NEW] Union of Concerned Scientists Releases New Coastal Resilience Report

Union of Concerned Scientists released a report titled “Looming Deadlines for Coastal Resilience: Rising Seas, Disruptive Tides, and Risks to Coastal Infrastructure”. The report, accompanying spreadsheets, and interactive map outline future sea-level rise and the associated risks for infrastructure in 2020, 2030, 2050, and 2100. Themes of affordable housing, science-based decision-making, and critical infrastructure impacts are also explored. 


National Strategy for a Sustainable Ocean Economy Issued

On June 5th, the Ocean Policy Committee issued a National Strategy for a Sustainable Ocean Economy. The Strategy fulfills US obligations under the High Level Panel for a Sustainable Ocean Economy and is intended to present “a whole-of-government vision for the policies and actions needed to support resilient, prosperous, and secure ecosystems, people, and communities in a dynamic and rapidly changing ocean environment.” CSO submitted comments on the Strategy in Sept. 2023.


The National Environmental Justice Thriving Communities Technical Assistance Centers (EJ TCATC) Launches Website

This newly established website facilitates direct support between communities pursuing environmental and climate justice and resources tailored to meet their specific needs. Key features of the website include detailed program descriptions, regional contact forms for technical assistance centers spanning all areas of the United States, and a curated grant search database. These elements will collectively ensure that communities have the necessary tools to advance their environmental and climate justice endeavors effectively. Visit the website at ejtctac.org


NOAA Invites Public Comment on Draft Regional Ocean Partnership Designation Guidance

The National Oceanic and Atmospheric Administration (NOAA) invites public comment on guidance on designating new regional ocean partnerships under the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (16 U.S.C. § 1468) (NDAA). The NDAA authorizes coastal states, Indian Tribes (including Alaska Native villages), and other entities to form new partnerships and to apply to NOAA as a regional ocean partnership. 

The designation guidance is proposed to address the membership, organization, and required elements of new partnerships. NOAA proposes to include the following information: introduction and background; instructions on submitting a new partnership application to NOAA; requirements for new regional ocean partnerships; and funding eligibility. The proposed designation guidance document and instructions for submitting comments may be found in the Federal Register. Comments may be submitted until Thursday, July 11 2024. Following the 30-day public comment period, NOAA will carefully consider comments before issuing the final regional ocean partnership designation guidance.

Offshore Energy & Infrastructure Work Group

The next work group call will be held early on Tuesday, July 9 2024 at 3pm ET / 2pm CT / 12pm PT to discuss draft language from a new federal Ocean Data Strategy and development of a work group resource repository. Reach out to John Ryan-Henry (jryan-henry@coastalstates.org) to add or remove names from the work group contact list.


Funding Implementation Work Group

The CSO Webpage for the work group now has a section for “eRA Commons Resources” – a set of documents/training from NOAA to help with common problems. Please share other resources that you find!

Coastal Nonpoint Source Work Group

In our recent meeting, we discussed CSO staff recommendation for sunsetting this work group as constituted. We will be redirecting our efforts towards more coordination with NOAA and EPA in getting challenges addressed for those programs who are still trying to get full approvals. We will also continue to serve as an adhoc convener if any member wants to discuss non point topics.
