Senator Caroline Menjivar (Democrat - 20th District) has introduced a very dangerous bill that seeks to impose a whole new set of rules for both commercial and residential leases and will turn the industry upside down. The bill has already garnered substantial support in Sacramento.
These are just a few of our concerns:
- This bill will require that leases be translated into multiple languages so a potential tenant can review the proposed lease in his/her/its native language. The cost of translating a commercial lease into another language typically starts at $10,000.

The bill seeks to limit cost recoveries (“NNN”) to a finite number of categories and specifically excludes taxes, parking, utilities, lighting and ADA upgrades among other things.
- The bill treats commercial and residential properties the same and does not take into consideration that the properties are different and require different services.
- This bill will penalize small property owners who typically have more limited resources.

The costs to landlords associated with this bill will be passed on to the tenants by higher base rent rates. This hurts the very parties the bill allegedly seeks to protect.
