On April 6, CCSNJ held its quarterly Rutgers Business Outlook. The panel consisted of experts from four different industries -- banking, warehousing & distribution, small business economy, and retail -- who shared their thoughts on South Jersey's performance in the first quarter of 2016 and the economic forecast moving into the second quarter of the year.

Importance of Estate Planning for Business Owners and Executives

In our practice, we often come across two types of high net worth clients: Business Owners and Executives. Federal and State estate taxes at combined rates of up to nearly 50% can adversely impact each group without proper estate and succession planning.
Business Owners: Where there is significant estate tax exposure, the Decedent's family will need the appropriate liquid funds to satisfy the tax liability. With a few, limited, exceptions, these taxes must be paid within nine months after the Decedent's death.

Many successful business owners leave estates which, while high in value, are mainly comprised of illiquid businesses ownership interests. Estate taxes may be imposed on these and other assets; however, these business interests may not be of much help in providing needed immediate funds to pay the estate tax. This can lead to difficulties that contribute to financial pressures and family dissention. Many family businesses are lost to such circumstances. Through proper planning, many estates can be structured in such a way as to avoid these pitfalls. For example, a portion of the business can be transferred by sale or gift to an irrevocable trust for the benefit of family members with the use of sophisticated valuation discounting and payment techniques; thereby potentially reducing the estate tax impositions and facilitating the efficient transfer of the family business to the next generations. Thomas J. Heitzman joined the Whitesell organization as executive vice president in 2002 and, in 2010, he became chief operating officer. He was named president in 2013.
Prior to joining the Whitesell organization, Heitzman was a partner in the law firm of Fox, Rothschild, O'Brien & Frankel, LLP (now Fox Rothschild, LLP), practicing in the firm's Real Estate and Financial Services Departments. Before joining the Fox Rothschild firm in 1992, he was associated with the Hannoch Weisman law firm in Trenton, NJ. Heitzman received a Martindale-Hubbell lawyer rating of "AV" in 2001. He is a member of the New Jersey and Pennsylvania bars (retired/inactive status).
Heitzman is a graduate of Rutgers University School of Law - Camden (J.D., 1990), the University of Richmond (B.A., 1986) and The Lawrenceville School (1983). He resides in Moorestown, NJ.

The results are in!
South Jersey businesses reported that growth in overall business activity picked up in the first quarter. Firms reported improved growth in overall company activity and sales along with an expansion in employment. Compared with previous surveys, firms reported a reduction in price pressures. Business expectations remained generally positive, and optimism improved compared with the fourth quarter. Employment forecasts for the future were also moderately stronger.
