Builder Plans Are Not RPRs
Our current AREA contract, 10.2, requires a seller to provide an RPR, (real property report), showing current improvements on the property with evidence of municipal compliance or nonconformance. RPRs are the single biggest cause of difficulty and concern for both sellers and buyers. We have discussed RPRs in a few previous emails:
Recently one of my referring realtors sent me a collection of material prepared by an Alberta Land Surveyor. It had a drawing of a lot and showed a home and a garage and had a lot of measurements. There was also substantial detail on the interior of the home and the elevation, and it had other useful information.
It looked pretty official, but it wasn't an RPR. The document was the builder’s plans to submit to the municipality as part of their application for permits. There was no contractual value for satisfying the 10.2 RPR clause, although the plans might be of interest to a new buyer.
An official RPR will always say, "Real Property Report” and will have the Alberta Land Surveyors’ Association logo in the bottom right hand corner, like this. (I encourage you to read the whole Surveyor's brochure, it's very informative.)
Lessons Learned
- Lots of issues around RPRs. Read all of our emails on this thorny topic.
- Builder plans are not RPRs.
- Always deal with RPRs at the listing stage.
