We’ve also updated benefit highlight flyers on Jet Mail for the all plan versions (Added Value, Signature and Choice), allowing you to order customized versions with your business information on them to use when meeting with clients.

Compliance updates and reminders

Final Rule for CY 2024 includes numerous updates and new regulations regarding the marketing and sales of Medicare Advantage and Part D programs effective September 30, 2023. Key changes include:

  • Marketing Events

A marketing event will no longer be able to occur within 12 hours of an educational event at the same location.

  • SOA 48-Hour Rule

Agents will have to obtain a signed Scope of Appointment (SOA) form 48 hours prior to the individual appointment with a prospect. The only exceptions to this rule are if the beneficiary is within four days of the end of a valid election period or when the meetings are unscheduled, such as walk-in meetings at an agent's office or kiosk.

  • Pre-Enrollment Discussion Criteria

Agents are required to discuss a list of items during the marketing and sale of a MA plan or Part D plan, including:

o information regarding whether or not the beneficiary's current providers,-specialists and hospitals are part of the plan's network;

o prescription drug coverage and costs, including whether or not the beneficiary's, current prescriptions are covered; and

o costs of healthcare services, premiums, benefits and specific health care needs.

Reminder: Enrollee Call Recordings

Per CY 2023 Medicare Advantage Marketing Policies - FAQ, agents are required to record all calls with enrollees, including calls that are outside the scope of the chain of enrollment. Calls that pertain to sales and enrollment processes must be maintained for ten years.

This includes call types with enrollees regardless of medium, so it includes Zoom calls and other calls using virtual presence technology. Agents must be able to provide calls recordings related to specific beneficiary interactions upon request.

There are several ways to record calls. Check with your field marketing organization for the options they offer. You can also use the WellSense Broker Recording Line at 603-417-4219. Simply enter your NPN to begin recording.
