BREAKING NEWS:  HHS Proposes Steep Penalties
HHS Proposes New Penalties - 10 K Per Day for Identified Overpayments

The Department of Health and Human Services (HHS) is on a mission to implement its new fraud and abuse powers under the Affordable Care Act (ACA).  On May 12, 2014, HHS took another big step by issuing a Proposed Rule that would, among other things, allow the Office of Inspector General (OIG) to impose costly Civil Monetary Penalties (CMPs) for a number of reasons.  Click HERE to see a list of conduct for which you could be fined under this Proposed Rule. You may comment on this Proposed Rule through July 11, 2014.

How Would This Affect Overpayments?

Right now, if an ambulance service identifies an overpayment, it has 60 days to refund the overpayment or it could be subject to liability under the Federal False Claims Act (FCA).   If the Proposed Rule is adopted as written, the government (or a whistleblower) wouldn't have to go through the process of filing a FCA action.  Instead, the government could simply impose up to a $10,000 penalty for every day after expiration of the 60-day deadline that an identified overpayment is not reported and returned.

For example, if your ambulance service identified an overpayment and didn't refund it to Medicare until 65 days after it was discovered, that oversight could cost you $50,000 just in CMPs if the OIG is able to impose the maximum penalty under this Proposed Rule.

This Rule comes just a few days after HHS announced a different Proposed Rule that would enhance the OIG's exclusion authorities. (Click HERE to read PWW's summary on that Rule).
