Advanced Mediation:  Role Plays, Caucusing, Impasses and More

A highly interactive two-day course for mediators who have some mediation experience, or have taken the Essentials of Mediation course, or its equivalent. The emphasis will be on role playing, and will also include theory and demonstrations. Participants may choose to focus on divorce role plays or business/commercial role plays. Topics to be addressed include:
  • Causes of and options for addressing impasses
  • When and how to use caucuses
  • Working with party representatives
  • Understanding leverage and influence in negotiations

         In two days, you will learn the basic substantive California family law on community property, parenting and custody, child and spousal support and Federal tax law applicable in divorces. The format is lecture and discussion with some small group exercises. A manual with detailed information on each subject area is included. This is an introductory course directed toward non-attorneys, although attorney-mediators new to family law will find it very helpful.

Understanding children's views provides the practitioner with a more integrated view of the child in the family and can lead to more informed recommendations, decisions, and work with parents. This workshop summarizes relevant research and the rationale for listening to children in different forums where decisions about children's lives are made. A structured child-focused interview model for obtaining children's views in mediation, collaborative family law, custody evaluations, guardian ad litem, and parenting coordination processes, as well as court-ordered therapy, is described, with opportunities for discussion and group exercises. Content includes description of six phases of the interview model, developmental issues in the use of language and questions, techniques for interviewing children, guidance for how to provide feedback to parents when appropriate, and examples of child interviews.
