Advanced Mediation Techniques

Participants in this program will learn the best way to prepare a client and a case for success in mediation, and how to navigate the obstacles that prevent settlement.

Participants Will Be Able to:

Explain the value of exchanging mediation briefs.
Identify 3 techniques to break through impasse in negotiation.
State the client disclosures required for mediation.

Speakers

Hon. Gary Nadler (Ret.)

JAMS

Judge Nadler has developed a reputation for settling challenging legal disputes throughout his career as both a judge and mediator. As a judge for 20 years on the Sonoma County Superior Court, Judge Nadler focused on resolving complex civil matters and case management prior to trial. As a neutral, he is known for his clear and focused understanding of the factual and legal issues and understanding the personal dynamics of the parties.

While on the bench, Judge Nadler was elected presiding judge by his judicial colleagues for two terms. He was appointed to consecutive terms to the Judicial Council of California by the chief justice of the Supreme Court of California. He was appointed as a pro tem justice to the First District Court of Appeal in 2022.

Kenneth Gack

JAMS

Kenneth D. Gack, Esq. has been a full time neutral with JAMS since 1996. Prior to joining JAMS, Ken practiced in civil litigation since moving to Sonoma County in 1978, with practice emphasis in bodily injury, real estate, construction and commercial disputes.

As an arbitrator and mediator, Mr. Gack has successfully mediated thousands of cases in a variety of civil litigation settings, served as the stipulated Special Master in a wide variety of construction matters, and arbitrated over 300 matters. He was awarded the Distinguished Mediator of the Year Award from San Francisco Trial Lawyers Association in 2004 and is a frequent speaker on efficient and effective alternative dispute resolution. Mr. Gack was awarded the Career of Distinction Award by Sonoma County Bar Association in 2019.

Gregory Spaulding

JAMS

Gregory G. Spaulding, Esq. brings over 40 years of experience as a distinguished trial lawyer to JAMS. As the founder of an AV-rated law firm, Mr. Spaulding has handled and supervised thousands of cases in diverse practice areas, including employment matters, medical negligence claims, business disputes, and trust and estate litigation. He has served as lead counsel in multiparty jury trials, estate disputes involving millions of dollars and catastrophic birth injury cases. He has represented clients in several high-profile cases, including matters involving the Doobie Brothers, Dana Carvey and several heirs of Jack London.

Mr. Spaulding’s people skills are one of his strongest assets. He takes pride in treating litigants and attorneys with dignity and respect. He brings focus to the work of finding an answer by listening carefully with empathy. Recognition of parties’ desires, and acknowledgement of the challenges and stresses of litigation, can produce significant changes to a position that seems firmly rooted.

Refund/Cancellation Policy: For programs hosted at the SCBA office or via Zoom, refunds will be granted if notice is given to SCBA by 3:00 pm 1 business day prior to the presentation. For programs hosted outside of the SCBA office, refunds will only be granted if notice is given 5 business days prior to the start of the program. A Refund Request Form must be submitted to the SCBA office in order to receive a refund. You may also request them by emailing Reception@SonomaCountyBar.org.
