APP VIRTUAL ANNUAL GENERAL MEETING SET FOR JULY 28, 2022

The Association of Pacific Ports is very pleased to invite you to our virtual AGM – July 28, 2022 at 4:00 pm Pacific Time.

Making the Law Work for 21st Century Ports:
A brief introduction to challenges we face and how the law can help us meet them

A Seminar by Law Office of Alan K. Goldstein for Association of Pacific Ports

Join us as Alan K. Goldstein provides insights into the challenges and solutions of today’s legal system. Alan's presentation will include:
  1. Setting the Scene: A host of factors including expansion of the Panama Canal, larger vessels (which need deeper channels and bigger berths), growing demand for U.S. energy exports, increasing dependence on automation and technology (and the cyber risk that accompanies them), climate change, geopolitical considerations and disruptions, and the new U.S. Infrastructure Investment and Jobs Act have ushered in an era of growth and complexity for Pacific ports. How can the law help advance rather than constrain ports and port authorities in trying to meet these challenges?
  2. The Paper Chase: Virtually every challenge ports face includes a significant legal component and much of that legal piece of the puzzle concerns contracts and related legal documents. Those pieces of paper are not meaningless “boiler plate” but instead essential ways of minimizing and allocating risk, defining rights and obligations, facilitating expansion and combatting claims and exposures if and when things go wrong. Accordingly, it makes abundant good sense to make sure, when negotiating and drafting, that your contracts and other legal documents work for, not against you. Let’s discuss some examples.
  3. Raising Revenues and the Commerce Clause: The difference between a proper port fee for services provided and an improper charge for privileges that taxes or discriminates against interstate commerce.
  4. Our Litigious Society: When lawsuits happen, sovereign immunity, defense and indemnification clauses, timely investigation, appropriate liability insurance and thoughtful advance planning can aid your defense.
  5. Audience Questions and Answers: “The important thing is not to stop questioning.” –- Albert Einstein

APP WELCOMES TYNEBRIDGE SOLUTIONS INC.

APP’s newest Associate Member – Tynebridge Solutions Inc. – has a very straightforward approach to projects: “Pragmatic Innovation”.

“We work well together, we enjoy a challenge and solving problems, and that’s what keeps us motivated,” said Robert Hedley, one of Tynebridge’s founding members. “We’re all very practical guys but with the distinction of thinking outside of the box.” While that may be true, Hedley, along with Stuart Crawford and Ben Thompson, also have some fairly high credentials and significant experience to back up that style.

Established in Vancouver BC in December 2021, Tynebridge Solutions Inc. is a relatively new entity, although Hedley, Crawford, and Thompson have known each other and worked together in the industry for over 20 years.

Commonwealth Ports Authority exploring options for Saipan International Airport

July 8, 2022 — The future of the Saipan International Airport is at the forefront of conversations within the Commonwealth Ports Authority (CPA) as the CNMI looks to the future of infrastructure following the COVID-19 pandemic. Recognizing the “once in a generation opportunity” made available through the national infrastructure development programs that have been created following the response efforts to the pandemic, the CPA seeks to engage the community on its plans for modernizing and upgrading the Saipan International Airport, according to CPA Board Chair Kimberlyn King-Hinds.

​BOEM seeks public comment on draft fisheries mitigation strategy

July 7, 2022 — As part of its efforts to ensure that offshore renewable energy development occurs in a thoughtful manner that minimizes conflicts with other ocean users, today the Bureau of Ocean Energy Management (BOEM) announced the availability of draft guidance on mitigating potential impacts of offshore wind development on commercial and recreational fishing and is inviting public review and comment on the draft.

Taiwan Port Corporation joins hands with Taiwan Port Association and Sun Yat-Sen University Xiwan Seedling Creation Association to create a carbon-reducing green farm

July 6, 2022 — In response to the International Cooperation Festival on July 2, the Kaohsiung Port Branch of the Taiwan Port Company cooperated with the Taiwan Port Association and the Kaohsiung Sun Yat-Sen University Xiwan Seedling Creation Association to cooperate in reducing carbon and increasing greenery and planting an idle space on the top floor of the company. Create an edible landscape that takes into account the visual landscape, and also plant vegetables in the teaching agricultural area in Zhongshan Kindergarten, so that children can know the types of vegetables, learn how to sow, cover and water, and experience the hard work of farmers in planting, which indirectly conveys self-sufficiency and food is not enough. The spirit of waste.

Trans Mountain Expansion Project: Marine spill response enhancements

July 5, 2022 — Western Canada Marine Response Corporation (WCMRC) has made significant progress delivering the spill response enhancement program for the Trans Mountain Expansion Project, which will see more than $150 million invested in new equipment, personnel and response bases in the Salish Sea. The enhancements are the largest-ever expansion of spill response resources in Canada and will double WCMRC’s existing response capacity and dramatically cut response times.

Hydrogen partnership to advance new pilot facility with CleanBC support

July 4, 2022 — The move towards more low carbon gases in B.C. continues as a new pilot project in Port Moody will produce zero-carbon hydrogen. A partnership between FortisBC Energy Inc. (FortisBC), Suncor Energy (Suncor) and Hazer Group Limited (Hazer) will bring a groundbreaking new technology to the province to produce clean burning hydrogen from natural gas.

Liebherr presents new mobile harbour crane

July 1, 2022 — With its new mobile harbour crane, Liebherr presents groundbreaking technical developments and updates that make the LHM product series fit for the future. The decisive innovation is the implementation of the “Master V” crane control system. Together with an even more efficient software architecture, this forms the basis for integrating future assistance and partial automation systems into the crane in the long term. Overall, the crane will become much more digital, networked, and smarter.

Port of Long Beach commends historic state investment in goods movement

July 1, 2022 — Port and City of Long Beach officials today applauded the approval and signing of the state of California’s 2023 budget, which will bring crucial state funding to the nation’s largest port complex, including $110 million for a planned goods movement workforce training campus to enhance safety and efficiency of cargo operations in the harbor. Statewide the budget includes $2.3 billion for goods movement and supply chain projects such as the replacement of older trucks with cleaner models, investments in zero-emissions terminal equipment and “high-priority” capital improvements in ports.

Taichung Port takes ESG to the next level, the first Taiwan international business port to obtain environmental education site certification

July 1, 2022 — Taichung Port Branch actively implements ESG corporate social responsibility and promotes environmental and ecological sustainability. In June this year (111), it successfully completed the review meeting of the Environmental Protection Personnel Training Institute of the Environmental Protection Agency of the Executive Yuan, becoming the first Taiwan international business port to apply for environmental education Facility site certified port.

Port of Guam to break ground on construction of Hotel Wharf

July 1, 2022 — More progress is happening at the Port Authority of Guam as the work will now begin on the construction and rehabilitation of Hotel Wharf. The Ground Breaking Ceremony occurred on Wednesday, July 6, 2022. The total cost for the project is $46,331,895. In June, the Port’s Board of Directors along with the Public Utilities Commission approved the bid awards for Phase I and II of the rehabilitation of Hotel Wharf (H-Wharf). Sumitomo Mitsui Construction Co. was awarded the bid.

Port of San Diego’s environmental efforts again recognized with Green Marine Certification

June 30, 2022 — The Port of San Diego has been re-certified by Green Marine, North America’s largest voluntary environmental certification program for the maritime industry. The Port first enrolled in Green Marine in 2018 and at that time was the second port in California to become a Green Marine participant. The re-certification covers calendar year 2021.

Port of Columbia County sets property tax levy to zero for third consecutive year

June 30, 2022 — Port of Columbia County Commissioners voted unanimously to adopt the 2022-2023 fiscal year budget and to set the port’s annual property tax levy to an assessed rate of zero for the third year in a row. “The port has proven over the years that it can be fiscally sustainable. Our strong financial position allows us to leave the tax levy at zero for another year and let that money stay with residents and businesses in the port district,” said Sean Clark, executive director for the port.
