 AAMP Obtains Temporary Stay Enforcing Pittsburgh’s

Rental Registration and Lead Safety Ordinance


ATTENTION AAMP MEMBERS


As you may know, the City of Pittsburgh was preparing to begin enforcement of its Rental Registration Ordinance following AAMP‘s victory in the court ruling that the fees they intended to charge were in fact a tax as the fees exceeded their cost of enforcement. Following this ruling, the city passed a new fee schedule with plans to begin their registration programs at the end of May. Simultaneously, the city adopted a “Lead Safe” ordinance imposing additional duties and obligation on rental properties, tying the duties to the rental registration program. While AAMP’s

initial challenge of the rental registration program was appealed to the Commonwealth Court, AAMP filed a supplemental challenge in the Allegheny County Court of Common Pleas raising objections to the new fee structure and provisions in the Lead Safe ordinance as well as new on-street parking permit restrictions that is also tied to the rental registration program.


Yesterday, the judge overseeing the new challenge granted AAMP a temporary stay in the city’s enforcement of the Rental Registration and Lead Safe Ordinances for a period of 90 days.
